A report from the magazine “Época” reports a conversation on August 25, at the Planalto Palace, between President Jair Bolsonaro and the lawyers of Senator Flávio Bolsonaro, Luciana Pires and Juliana Bierrenbach.
According to the magazine, Jair Bolsonaro summoned Minister Augusto Heleno, head of the Institutional Security Office (GSI), and Alexandre Ramagem, director of the Brazilian Intelligence Agency (Abin) to the meeting.
The report informs that the lawyers stated in the conversation that they had discovered the key to annulling the Queiroz case in court, they presented documents that, in their opinion, would prove the existence of a criminal organization installed in the IRS, responsible for gathering information that would support the former Coaf (Council for the Control of Financial Activities), currently called the Financial Intelligence Unit.
One of these reports revealed the scheme that, according to the Federal Public Ministry, would have the participation of Flávio Bolsonaro, the president’s son: the embezzlement of public money in the Legislative Assembly of Rio de Janeiro through the “crackers”, the practice of parliamentarians to take part of the salary of employees.
In the office of the then state deputy Flávio Bolsonaro, the scheme, according to the Public Ministry, was administered by Fabricio Queiroz.
According to the report, the senator’s lawyers presented documents according to which a group of employees of the Internal Revenue Service of Rio de Janeiro would be feeding the control bodies, including Coaf, with confidential data on politicians, businessmen, public officials, among others. . others.
One of these documents would be a process of the National Union of Federal Income Tax Auditors of Brazil (Sindifisco) that reports that employees of the Internal Revenue Service in Rio would be the target of illegal investigative practices by their colleagues.
The lawyers argued, according to the magazine “Época”, that these officials would be prosecuted for refusing to participate in irregular actions carried out by colleagues, such as making apocryphal complaints, which would represent a misuse of the purpose.
The defense thesis was that the report on the alleged schemes in the office of the then state deputy Flávio Bolsonaro and 21 other parliamentarians of the Legislative Assembly of Rio de Janeiro has identical characteristics to the irregular practices of which the Tax Service was accused Rio interns, according to the report.
In January of this year, after the investigation was concluded, Sindifisco closed the accusation against these affiliated internal affairs officials, claiming that they saw no connection in the events reported by them with any violation of the union’s statutes. Therefore, there was no evidence that they were actually persecuted, or that they were not.
Sindifisco reported in a note to Jornal Nacional that the Federal Treasury does not transmit information to Coaf, the exact opposite occurs. Coaf is the body that produces financial intelligence reports, the so-called RIFs, based on information provided by financial institutions that are obliged to inform the body about unusual financial transactions.
Also according to Sindifisco, the mission of the Internal Revenue Service is to investigate disciplinary infractions of public officials and does not get involved in matters related to tax inspections of taxpayers.
The meeting at the Planalto Palace with Flávio Bolsonaro’s lawyers was not on the official agenda of the president or Minister Augusto Heleno, but it was confirmed by them to the magazine “Época”.
According to the report, the head of the GSI and the director of Abin left the meeting with the mission, on behalf of the security of the presidential family, to check if the script narrated by the defense of Flávio Bolsonaro was upheld. Most importantly, obtain a document proving that the senator was the victim of illegal debauchery by members of IRS intelligence. They were not tested, according to “Epoca”
Flávio Bolsonaro, then, would have sought the Secretary of the Treasury, José Barroso Tostes Neto. It was also unsuccessful.
According to the report, Bolsonaro called Tostes Neto to talk a few weeks ago. She heard from him that, after a search, nothing had turned up to support the defense’s suspicions.
On September 29, the senator sought the help of Gurjão Barreto, executive director of the government’s Federal Data Processing Service (Serpro).
The two met in Brasilia, outside the agency. The attempt also failed. Serpro claimed to have a confidentiality agreement with the IRS, which would be violated if any data were provided.
Senator’s defense note
In response to the report, the defense of Flávio Bolsonaro said in a note:
The defense of Senator Bolsonaro clarifies that the suspicions of irregularities in the information contained in the tax investigation reports prepared in his name drew the attention of the GSI, since they differed greatly from the characteristics, content and form of the same reports prepared in other cases , noting that previous reports from the same body did not point to any indication of atypical activity on the part of the senator. Finally, it also stated that the act was denounced directly to the GSI for having been practiced against a member of the family of the President of the Republic. ”
Try to stop counting
This was not the first attempt by Flávio Bolsonaro’s defense to quash or stop the investigation.
In July last year, at the request of the senator’s defense, Minister Dias Toffoli, then president of the Federal Supreme Court, temporarily suspended all ongoing investigations in the country that were based on confidential data shared by Coaf and the Treasury without prior authorization from Justice.
But in November, the STF plenary held that it is legal for the IRS to share tax returns and bank statements with the Public Ministry. However, the court ruled that this must take place within official channels. With this decision, the investigation of the case of Flávio Bolsonaro could be resumed.
The Rede and PSB parties announced that they will begin collecting signatures in the Chamber and the Senate to request the opening of a CPI to investigate the use of public bodies for the benefit of Senator Flávio Bolsonaro.
“We will search. The facts are very serious in any other circumstance. It would make the installation of a parliamentary investigative commission inevitable. Obtaining the signatures, the first step, the first challenge is to obtain the signatures, we will do everything possible with the presidents.” of the houses so that the CPI request is installed, it is accepted, ”said Senator Randolfe Rodrigues (Rede-AP).
The Network will also ask the Supreme Court to resign from the functions of Minister Augusto Heleno and Abin’s director, Alexandre Ramagem, and to prohibit President Bolsonaro from interfering in investigations into their son.
“The President of the Republic cannot use the position for personal, private or family purposes. He cannot use the force of his position to access information, for example, which is confidential. Note that the complaint indicates that some agents The public they refused to hand over the requested information because it was confidential information. But they were pressured, “said Congressman Alessandro Molon (PSB-RJ).
Public agency versions
The Jornal Nacional requested advice from the Palácio do Planalto, which stated that the body that should respond was the Office of Institutional Security.
The GSI confirmed that it had been contacted by Flávio Bolsonaro’s lawyers. He declared that the issue could seem institutional security because it involves a member of the president’s family.
But GSI said that the complaints presented by the lawyers turned out to be an internal matter of the Federal Treasury and that, respecting its legal powers, it did not take any action.
The Brazilian Intelligence Agency did not comment on the presence of its director at the meeting described by the magazine “Época” and sent the same note sent by the Office of Institutional Security.
The IRS declined to comment.
Serpro did not respond to the request for information.
