The STF currently four actions that address the issue: three in favor of a more comprehensive and / or mandatory vaccination, and one that calls for the prohibition of mandatory vaccination. Lewandowski’s decision this Friday only refers to the first three.

In one of these actions, the PDT seeks to ensure that the determination of mandatory vaccination and other related measures is the responsibility of the states and municipalities.

The party emphasizes that this attribution must be recognized by governors and mayors, provided that the measures are supported by scientific evidence and provide greater protection.

The PDT action was motivated by the statement of President Jair Bolsonaro in which he affirms that the Ministry of Health will not force the population to take a possible vaccine against Covid-19. On Wednesday, Bolsonaro announced that Brazil would not buy “the vaccine from China,” prompting a pushback from the ministry, which had already met with governors to address the issue.

According to the PDT, a possible omission by the federal government should not be an obstacle to adoption by smaller entities [estados e municípios], of measures that serve the realization of fundamental rights, such as, in the case of the case, public health ”.

“If the Federal Government omits its constitutional duty of protection and prevention through mass immunization, the States cannot undertake the opposite effort, that is, greater protection, as long as it is backed by solid scientific evidence,” the action states. .

The Sustainability Network questioned in the STF, in another action, the conduct of Jair Bolsonaro when he disavowed the Minister of Health, Eduardo Pazuello, and suspended the purchase of the product developed by the Chinese laboratory Sinovac with the Butantan Institute, in São Paulo.

According to the party, by vetoing the purchase of the vaccine, Bolsonaro “intends to deprive the Brazilian population of the possibility of preventing Covid-19 out of pure ideological prejudice or, worse still, for strictly political reasons.”

On Tuesday (20), Minister Eduardo Pazuello had announced the purchase of 46 million doses of Coronavac, a measure praised by the governors.

In another action, the opposition parties (PSOL, Cidadania, PT, PSB and PCdoB) request the Supreme Court to send the Executive to present within 30 days the government plans and programs related to vaccines and drugs against Covid-19, in addition to planned investigation actions, deals, protocols of intention or understandings.

The opposition also demands that the government be prohibited from carrying out acts that hinder investigative measures or protocols of intent.

But on Wednesday, in a social network, the president said: “João Doria’s Chinese vaccine, any vaccine before it is made available to the population, must be scientifically tested by the Ministry of Health and certified by Anvisa. The people Brazilian will not be anyone’s guinea pig. My decision is not to buy the vaccine. ”

Later, the executive secretary of the Ministry of Health, Elcio Franco, explained that the ministry has the intention and does not want to buy the vaccine from China. “There is no intention to buy Chinese vaccines,” he said.

PTB went to the STF against mandatory vaccination against coronavirus. The party is demanding that court ministers suspend a section of a law passed earlier this year that empowers public officials to determine mandatory vaccination of the population.

Bolsonaro’s ally, the PTB, says that the possibility of compulsory vaccination violates rights provided in the Constitution, among them, individual freedom and the health of the community.

This last action, by PTB, was not included by Lewandowski in the dispatch that brought the issue to the plenary session of the STF. This does not prevent the process from being placed on the agenda until the day of the trial.
