The president of the STF (Federal Supreme Court), Luiz Fux, said on Friday (23) that he welcomes Justice to enter the discussion on the new coronavirus vaccine and make a decision on it.
“You can write, there will be a judicialization, which I think is necessary, which is this issue of vaccination. Not only individual freedom, but also the prerequisites for adopting a vaccine ”, stressed the minister.
The minister issued the statement after stating that it is common for the most varied issues to stop at the Supreme Court and demand a response from the court. “The Supreme Court had to decide the Forest Code. Who understands the Forest Code in the Supreme Court? No one was trained in this. School age, who understands pedagogy there? Medical problems, ”said the minister.
Last Thursday (22), the Rede Sustentabilidade party asked the Supreme Court to force the federal government to buy 46 million doses of Coronavac, a vaccine produced by the Chinese pharmaceutical company Sinovac in association with the Instituto Butantan, linked to the government of São Paul. .
The matter became a subject of dispute between Bolsonaro and the governor of São Paulo, João Dória (PSDB).
The Minister of Health, Eduardo Pazuello, even announced an agreement to purchase the vaccines, but the next day, President Jair Bolsonaro (without a party) ruled out the purchase by the government until there is proof of effectiveness.
In addition, a lawsuit is underway in court looking at whether the state can force parents to vaccinate their underage children. In September, the court declared that the decision will apply to the entire judiciary in Brazil.
The issue has yet to be tried, but it involves a discussion that may impose beacons in the specific case of Covid-19.
This Friday, Fux said that the discussion should be prosecuted, but did not elaborate on how the Supreme Court can deal with the issue.
The minister delivered the statement at the online event on the role of the Judiciary in the current crisis scenario, held by the Alliance for Business Defense.
Speaking, Fux stressed that he has the desire to regain the “respect” of the Supreme Court: “My dream is to make the Supreme Court respect the time of Víctor Nunes Leal, of the great Sepúlveda Pertence jurists. I want the STF to be respected and, for that, we created several fronts of action in the STF and the CNJ ”.
The minister also defended the importance of respecting the division of powers and said that he does not want “the judicial role of the STF to interfere in theses that are not within its competence.
