The Minister of the Federal Supreme Court (STF), Alexandre de Moraes, is the new rapporteur for the investigation that investigates whether President Jair Bolsonaro tried to intervene in the autonomy of the Federal Police.

The name was defined by lottery by the electronic system of the STF, after the president of the Court, Minister Luiz Fux, determined the redistribution of the case among the court ministers.

The decision followed a request from the defense of former minister Sergio Moro, who is also being investigated in the investigation. The original reporter of the process in the STF was Minister Celso de Mello, who retired from his post on the 12th.

Due to normal progress, the files in Celso de Mello’s office should move to his replacement in office. President Jair Bolsonaro appointed Judge Kassio Nunes Marques to the vacancy, but the name must be confirmed by the Senate. Marques’s hearing should take place this Wednesday (21).

Moro’s lawyers argued that the redistribution was necessary because the investigation is an urgent procedure.

The investigation is awaiting another decision from the Supreme Court, related to the format of President Jair Bolsonaro’s statement to the PF.

Then the rapporteur of the case, Minister Celso de Mello, voted in favor of defining a face-to-face deposition: it was Mello’s last vote before retiring. The Attorney General’s Office wants Bolsonaro to be able to speak in writing.

Jair Bolsonaro and Sergio Moro are included in the investigation as investigated. The investigation was opened with the approval of the Supreme Court because Moro, upon leaving office, accused the President of the Republic of trying to interfere politically with the command of the Federal Police.

According to Moro, Bolsonaro requested intelligence reports and requested changes in the leadership of the corporation. The President of the Republic denies the charges.

Moraes is already the rapporteur of two other inquiries in the Supreme Court that annoy the government and affect the president’s allies:

Fux’s decision comes a day before Kassio Marques’s hearing at the Senate Constitution and Justice Committee, who was chosen by Bolsonaro to replace Celso de Mello. According to the rules of the Court, if there were no redistribution, Marques would inherit the rapporteur of the case.

The STF has yet to define the model for the president’s testimony in the investigation: whether it will be in person or in writing. Celso de Mello voted to maintain his order to be in person. There are still ten votes left and there is no deadline to resume the case.
