The president of the Federal Supreme Court, Minister Luiz Fux, published a resolution this Thursday night (10/15) that defines complementary rules on the system of distribution of judicial cases.
From now on, a distribution certificate will be included in each process, which will contain the parameters used, in addition to the justification of the normative provision on which the server was based, the process number and the names of the ministers that may be excluded. .
Information about the distribution should be available under the “general information” tab on the court progress pages of the court website.
It is also foreseen that the distribution of cases will not be made once the STF’s working hours have ended, except in situations of “death of law”. The distribution time will be predetermined by the president of the court.
Fux also created a working group to “improve security, transparency and randomness in the distribution of processes”, which will carry out analyzes on the subject. The group will operate for 30 days, renewable.
Case concrete
The changes come after Minister Gilmar Mendes previously pointed out the possibility of distribution fraud. In the sentence suspending the amparo, which determined that the drug trafficker known as André do Rap should be detained again, Gilmar recalled that Rosa Weber was the narrator of the operation that detained the accused. Thus, the minister was expected to remain on trial to judge Habeas Corpus, which was randomly distributed to Marco Aurélio.
The minister said that, in the specific case, not even the Attorney General’s Office “is immune from criticism,” since it presented the challenge only on Saturday.
“It was only on Saturday, October 10, 2020, when the release order had already been fulfilled, that the park filed the request for protection under examination, on Saturday, at 7:46 p.m. This one only came on Saturday! Tuesday. It is a party of errors, mistakes and omissions! Gilmar said.
