President Jair Bolsonaro told the ministers of the Federal Supreme Court (STF) that he chose the replacement of Celso de Mello’s place on the field. Kassio Nunes, judge of the Federal Regional Court (TRF) of the 1st Region, would have been elected, according to reports published by the newspapers Folha de S.Paulo and O Globo this Wednesday (30).
Kassio Nunes, who was not among the names cited for the position on the Supreme Court, was a candidate for a vacancy on the Superior Court of Justice (STJ), which will open with the departure of Minister Hugo Napoleão. According to columnist Lauro Jardim, from the newspaper O Globo, the judge, with a Catholic profile, was at the Planalto Palace last Tuesday (29), where he met Bolsonaro.
O Globo also claims that Kassio Nunes is considered a very productive judge, with a high average of court decisions per day.
The appointment of the president of the STF, which has not yet been made official, has yet to be heard in the Senate and voted on in the House Plenary. The Folha de S.Paulo report affirms, however, that the effectiveness of the appointment of Kassio Nunes to the Supreme Court is viewed with reservation in legal and political circles, since Bolsonaro has already reversed other important decisions during his government.
Vacancy will open with the retirement of Celso de Mello
In November, Celso de Mello turns 75, the maximum age to be a minister of the STF and, therefore, must necessarily retire. However, last week he decided to take his retirement date to the Supreme Court before October 13.
This opens the first wave that Bolsonaro will have the right to nominate for the STF. Until the end of his term in 2022, the president may appoint another minister. That’s because Marco Aurélio Mello will be retiring next year.
