The original decision was made after an action by Sindeclubes, a union that represents employees of Rio de Janeiro clubs. In the document, the entity alleges “high risk of contagion” from the coronavirus. The president of Sindeclubes is José Pinheiro dos Santos, Flamengo’s security officer. According to him, the action was taken at the request of the red-black employees themselves.

With this decision, the next instance in which CBF can appeal is in the Superior Labor Court (TST).

CBF alleges that the Flamengo outbreak was an isolated event

Among the arguments used, CBF stated that Sindeclubes did not have legitimacy for the action, since it does not represent professional soccer athletes. The organization also recalled the episode of the photo published by Flamengo with players without masks, which led to the dismissal of a communication professional from the club.

CBF also affirmed that, with the preventive procedures, the risk of contagion of the coronavirus is small and that what happened with Flamengo was “an isolated event, which cannot be attributed to the Brazilian Soccer Championship.”

Judge María Helena Motta, responsible for the decision, rejected the CBF’s arguments and recalled that the situation “affects the players, the members of the technical committee, the board, in addition to those already mentioned, without distinction.”

The Flamengo delegation is still in São Paulo, where it arrived on Saturday afternoon. The club maintains its usual schedule so as not to be taken by surprise in case a new decision allows the game to develop.

On Saturday night, the STJD rejected Flamengo’s request for a review. According to the organ’s understanding, there are conditions for the pairing to take place. Even so, the TRT decision is still valid.
