Globo is prohibited from showing documents against Flávio Bolsonaro

The 33rd Civil Court of Rio de Janeiro granted, this Friday (9/4), provisional protection to avoid TV Globo to show any investigation documents on a cracking scheme that allegedly took place in the office of current senator Flávio Bolsonaro when he was a state deputy in Rio.

The request was made this Thursday (9/4) by the defense of Flávio Bolsonaro, led by lawyers. Rodrigo Roca me Luciana Pires. The process is carried out in secret of justice.

The Public Ministry of Rio suspects that the employees who passed through Flávio Bolsonaro’s office when he was a state deputy returned part of their salaries to the parliamentarian, in an operation known as “rachadinha.” There is a suspicion that the scheme would be led by former adviser Fabrício Queiroz.

In June, the Third Criminal Chamber of the Rio de Janeiro Court of Justice concluded that Flávio Bolsonaro has a privileged forum in the investigation of a “cracked” scheme in his office in the Rio de Janeiro Legislative Assembly for being a State deputy at the time of the facts.

However, the MP-RJ argued that the decision of the 3rd Criminal Chamber of the TJ-RJ violated the understanding of the Supreme Federal Court. Thus, he defended the investigation to return to the first instance.

In 2018, the Supreme Plenary restricted the scope of the forum by function prerogative. For ministers, parliamentarians only have a special forum if the events attributed to them occur during the period, depending on the position. In the case of crimes committed previously, the parliamentarian must be prosecuted by the first instance of Justice, like any citizen. With the end of the mandate, also ends the privileged forum, established the Court.
