The Plenary of the Senate approved the bill that extends the validity of the driver’s license to 10 years (PL 3.267 / 2019). The decision was made by remote session. The text is an initiative of the Executive Power.
The proposal was approved by the Chamber of Deputies in late June. As amended in the Senate, the bill will return for a new vote in the House.
The project has a series of amendments to the Brazilian Traffic Code (CTB – Law 9.503, 1997). Among them, the National Driving License (CNH) will be valid for ten years for drivers up to age 50.
Today, the general rule is valid for five years. The proposal also establishes five years for drivers between the ages of 50 and 70; and three years for drivers aged 70 and over.
Informed by Senator Ciro Nogueira (PP-PI), the text also determines that physical and mental fitness tests are performed by examining expert doctors and psychologists. The project also changes the rules for the use of car seats or booster seats, adding weight and height references to the 10-year limit.

Currently, the rules for the car seat are in the infralegal legislation. The text also establishes more lenient rules for wallet retention and for toxicology tests.
Modernization and Education
The rapporteur, Senator Ciro Nogueira (PP-PI), said that the project is a modernization of traffic legislation. For the senator, the more the bureaucratic burden “that weighs on the shoulders of ordinary citizens is reduced, the more we will reduce the cost of Brazil, with positive effects on growth and employment.”
“After almost 23 years of the approval of the CTB, adjustments to this diploma are necessary, due to the rapid changes that occur in traffic,” said the rapporteur.
Senator Eduardo Braga (MDB-AM) affirmed that the project has the merit of making the score for the suspension of the portfolio more flexible, from 20 points, for those who have more serious infractions, reaching up to 40 points, for those with minor infractions .
The leader of the government in the Senate, Fernando Bezerra Coelho (MDB-PE), said that the matter was referred to the National Congress in June 2019. According to the senator, it was a year of debate in the Chamber of Deputies, with six public hearings , with the participation of Brazilian society. He pointed out that the project is important, for example, for professional motorcyclists, who will have more guarantees of not having their vehicle impounded.
