Today the Public Ministry sent to the STJ (Superior Court of Justice) an opinion defending the maintenance of the removal of Wilson Witzel (PSC) from the post of governor of Rio de Janeiro.
In the document, the body states that “there is no doubt that it is the responsibility of the Minister Rapporteur, considering the urgency of the case, to grant precautionary measures, including imprisonment and dismissal, which can be legitimately imposed on the Governor of the State.”
Although the Federal Public Ministry remains convinced of the need for the preventive detention of Wilson José Witzel, it still understands that E. Minister Benedito Gonçalves, in calm and careful reflection, in a well-founded decision, legitimately chose to grant the Governor one last chance, granting only the alternative precautionary measure provided for in article 319, VI of the Criminal Procedure Code, which must be endorsed by the Special Court “.
The Special Court of the STJ must assess tomorrow whether Witzel remains out of office. The PGR writes: “Already in the first complaint presented, the seriousness of the situation is seen, with concrete elements of evidence, among them money that goes directly to the account of the governor and the first lady, causing Wilson José Witzel, in the exercise of his position, incurred in 25 crimes of high passive corruption and 25 crimes of money laundering “.
“However, given the complexity of the facts and the investigation, new criminal actions will be triggered, adding that in the coming days a complaint will be offered for the practice of the crime of constitution and belonging to a criminal organization.”
Minister Benedito Gonçalves ordered Wilson Witzel to resign as governor for 180 days as a result of the investigations into Operation Placebo.
Both Witzel and the PSC questioned the withdrawal in the STF (Federal Supreme Court).
