The investigation into the supposed “cracked” scheme (delivery of part of the salary, by the advisers, to the parliamentarian or some ally) in the office of today Senator Flávio Bolsonaro (Republicans-RJ) when he was a state deputy in Rio de Janeiro It was concluded by the Public Ministry of Rio de Janeiro (MP-RJ), according to the institution, that it will now decide whether to report it or not.
The son of President Jair Bolsonaro was investigated for embezzlement, money laundering and criminal organization, in a scheme that would have been part of his then parliamentary adviser Fabrício Queiroz, dismissed in 2018, when the first signs of irregularity appeared in Flávio’s office. Queiroz is under house arrest in Rio de Janeiro.
The MP-RJ reported, in a note, that “the Specialized Action Group in the Fight against Corruption (Gaecc / MP-RJ) sent this Monday to the State Attorney General’s Office the criminal proceeding referred to the ‘Flavio Bolsonaro Case’, communicating the conclusion of the investigations. For this reason, the files, which are secret, were sent to the Deputy Attorney General for Criminal Justice and Human Rights (Sucriminal / MP-RJ) for further action ”.
Until July, the investigation was carried out in the first instance, before the 27th Criminal Court of Rio, and was in charge of Gaecc, whose members could denounce Flávio before the Justice, if they considered constant evidence of the crime. But the Rio State Court of Justice (TJ-RJ) granted the senator the right to a privileged forum due to the prerogative of office – as a deputy, according to the court, he has the right to be tried directly by the second instance. Then the case went from Court 27 to the Special Body of the TJ-RJ, made up of 25 judges, and the prosecution left the scope of Gaecc and went to the attorney general, Eduardo Gussem.
Gussem signed a cooperation agreement with Gaecc so that the group could continue with the investigation, now concluded. The eventual complaint, however, can currently only be made by the attorney general himself.
The MP-RJ appealed the decision of the TJ-RJ to grant Flávio a privileged forum and tries to suspend this right before the Federal Supreme Court (STF), which has not yet ruled. Therefore, the MP-RJ has two possible behaviors, should it decide to denounce the senator: report him directly to the Special Body of the TJ-RJ, in compliance with current regulations, or wait for the decision of the STF for the eventual return of the process in the first. For example, in this case, Gaecc himself could file the complaint with the 27th Criminal Court.
In a statement, Flávio’s defense stated that the MP-RJ statement is a liar. “It is not true that the investigation was completed on this date. I had already finished with the senator’s hearing, ”says the text. “The Gaecc promoters maneuvered to find an honorable exit from the Group to get the job done. The group could not investigate Senator Flávio Bolsonaro, which resulted in representation in the National Council of the Public Ministry (CNMP) due to the false designation of said group to continue investigating the parliamentarian. The deadline would end on Monday (31) for the explanations of the attorney general. There is also a procedure with the CNMP to investigate the constant leaks of the process that is handled confidentially, “says the text.
