TCU determines that military personnel return the benefit received

The Federal Court of Accounts (TCU) determined today that the more than 73,000 soldiers who received emergency assistance of R $ 600, paid to informal, autonomous and unemployed people, return the full amount of the benefit.

The preliminary decision, signed by Minister Bruno Dantas, also defined that, if the amounts are not reimbursed at the end of the May payroll, the amount received irregularly will be deducted from the military’s salary.

The return must be made through the Union Collection Guide (GRU).

In the office, Dantas recalls that the government inspection team found evidence of irregular payment of emergency aid to military personnel on the payroll of the Defense Ministry. This, according to the minister, “would characterize a serious irregularity, since the beneficiaries do not meet the legal criteria for the concession.”

“There is no legal hypothesis, even for the most convincing interpretation of Law 13.982 / 2020, for an active and inactive military or pensioner to be the holder of emergency aid,” says Dantas. “The resources used must be urgently reallocated to beneficiaries who meet the requirements of the law.”

73,142 CPF were identified in the database of the ministry that received the benefit irregularly, including active, inactive, career and temporary military personnel, in addition to pensioners, dependents and amnesties. In total, the government spent at least R $ 43.9 million in the payment of the first installment to these military personnel.

If the errors were not identified, according to the Ministries of Defense and Citizenship, R $ 131.8 million would be spent on the three installments.

The TCU minister still demands that the reimbursement be “prompt and complete”. “The Court has a long history of inspecting improper payments of social benefits and this experience shows a long and ineffective process of reimbursing these payments,” he justifies.

The legislation determines that, for three months, R $ 600 emergency aid will be granted to informal workers, on their own account, in intermittent or unemployed contracts. The woman who is also the head of the family is entitled to two quotas (R $ 1,200).

For this purpose, the beneficiary must:

  • Being over 18 years;
  • Not have an active formal job;
  • Do not receive any other social security benefits or assistance, except Bolsa Família;
  • Not be a beneficiary of unemployment insurance;
  • Have a per capita family income of up to half the minimum wage (R $ 522.50) or a total family income of up to three minimum wages (R $ 3,135);
  • In 2018, not having received taxable income greater than R $ 28,559.70.

Individual micro-entrepreneurs (MEI) and individual taxpayers to the General Social Security System (RGPS) are also entitled.
