The Minister of the Supreme Federal Court (STF) Celso de Mello determined, this Thursday (30), that the Federal Police will listen to former Minister of Justice and Public Security Sergio Moro within a period of five days.
He is expected to testify on charges that President Jair Bolsonaro attempted to interfere with the work of the PF and in consultations related to family members.
Last Tuesday (28), Celso de Mello had determined that the testimony would be collected within 60 days. The investigation, which was authorized by the STF, will investigate whether Moro’s allegations are true. If they are not, the former minister may face justice on defamatory charges and crimes against honor.
The request to reduce the deadline was sent to the STF this Thursday afternoon by three parliamentarians: Senator Alessandro Vieira (Cidadania-SE) and deputies Tabata Amaral (PDT-SP) and Felipe Rigoni (PSB-ES).
“The due diligence now determined must be carried out by the Federal Police, within 05 (five) days, considering the reasons invoked by the parliamentary Lords who sign, together with their distinguished attorneys, the petition to which I referred previously “Celso de Mello defined.
On Tuesday, Minister Celso de Mello gave PF 60 days to collect Moro’s testimony.
In the testimony, the former Minister of Justice will formalize what he said in a statement last Friday. leaving the government and can still deliver evidence.
The 60-day period had not yet begun to count because Celso de Mello determined that, before sending the query to the PF, the Attorney General’s Office should comment on a request to confiscate the cell phone of Congresswoman Carla Zambelli (PSL- SP).
In the new decision, the minister anticipates that “after the investigation of Mr. Sérgio Fernando Moro has been carried out, the Public Ministry will be heard.” In practice, the PF no longer needs to wait for this document from the PGR to listen to the former minister.
Celso de Mello also determined that the Investigation Service of the PF’s Directorate of Investigation and Combat of Organized Crime (Dicor) be called to collect Moro’s testimony. The area is commanded by the delegate Igor de Paula, who has already coordinated the Lava Jato task force in Curitiba.
Also on Thursday night, Celso de Mello rejected a habeas corpus request from a lawyer trying to annul the dismissal of Sergio Moro and former PF director Mauricio Valeixo, alleging “procedural failure.” The minister did not analyze the arguments because he considered that the method was inappropriate.
Messages exchanged by Moro and revealed by Jornal Nacional show that Carla Zambelli tried to convince Moro to remain in office, amid a controversy related to the change of command in the Federal Police.
The messages revealed by Moro to JN provoke reactions from legal and political circles.
The MP offered to try to convince President Jair Bolsonaro to nominate him for a vacant position as minister of the Supreme Federal Court. Moro left the government after the president removed the delegate Maurício Valeixo from the PF command.
“The seriousness of the accusations directed at the President of the Republic, in our opinion, added to the serious political crisis that the country is going through, leads us to believe that the period of 60 (sixty) days to carry out due diligence in the Screening may be excessive, especially since the prolongation of the political crisis results in losses to combat the concomitant crises in Health and Economy. In this sense, the elasticity of the term granted may result in an imminent risk of loss of evidence, “say the parliamentarians. in the request accepted by Celso de Mello.
In the application to the STF, the trio of parliamentarians also demanded that Celso de Mello determine the maintenance of the delegates in the current investigations that they command in the STF. The idea is, precisely, to prevent this supposed “interference attempt” from being implemented by the new Federal Police command.
“The reason is that the new Minister of Justice [André Mendonça], as well as the future director general of the Federal Police, can cooperate, even if indirectly, to satisfy the wishes of the President of the Republic, against the autonomy of that organism, “they wrote.
On this, Celso de Mello also requested that the matter be sent to the Public Ministry. This compliance, in the same way, does not prevent the count of the deadline for the deposition of Moro.
In the midst of the debate on interference in cooperation, Minister Alexandre de Moraes determined that the FP prevent delegate teams from consulting on false news and undemocratic acts in an attempt to “protect” investigations.
