The prosecutor of the Republic, Raquel Branquinho, officially said that President Jair Bolsonaro violated the Constitution by ordering the Army to repeal the ordinances that facilitated the tracking of arms and ammunition.
Branquinho prepared a letter that is being processed within the attorney general’s office and the agency will now decide whether to open a procedure to investigate the president’s conduct. The request to open an investigation was revealed by the newspaper “O Estado de S.Paulo”. Globo TV also had access to the document. If the attorney general’s office sues the courts, Bolsonaro can even answer for administrative wrongdoing.
The ordinances related to the letter were published by the Army. On April 17, the president wrote on a social network that he had ordered the repeal of the texts. For the prosecutor, there are elements that point to Bolsonaro’s interference in exclusive acts of the Army.

The texts established greater control over weapons and ammunition, but Bolsonaro affirmed that they were against the proposals he has presented since the electoral campaign.
For Raquel Branquinho, the episode represents an extremely serious situation and has the potential to exacerbate the public security crisis in the country. This is because, according to the prosecutor, there is no doubt that, according to the legislation, the Logistics Command of the Brazilian Army is responsible for inspecting controlled products, such as weapons and ammunition.

“The regulatory powers of the President of the Republic exist and are based on the Constitution of the Republic and the law, so there is no room for voluntary ideas and attitudes, even if they are based on good intentions,” he wrote.
In Branquinho’s assessment, relaxing the rules can favor organized crime.
