2nd round elections: How to justify voting in case of absence

RIO – Those who do not appear at the polls for the second round of the municipal elections this Sunday, November 29, must justify their absence so as not to have suspended some civil rights. This year, voters will be able to complete the process by cell phone or tablet through the e-Title application (which replaces the physical version of the voter ticket) due to the Covid-19 pandemic. Voting can also be justified over the Internet.

How to justify the vote

In addition to the application, it is possible to carry out the electoral justification of an application on the TSE website. The Electoral Justice informs that the presentation of the justification is made in online channels. Voters have up to 60 days to present the justification before the judge of the electoral zone, accompanied by the supporting documentation the inability to attend the election, which can be a medical certificate or other document proving the absence, such as a travel ticket or proof. The rule works for those inside or outside the electoral domicile.

The TSE indicates that the voter must complete the Electoral Justification Request (RJE) form.   • Access https://justifica.tse.jus.br/ to start the process. When opening the screen, click on the “start justification request” rectangle;
  • On the next screen, provide the data requested by the TSE: voter registration number, full name and date of birth. Click on the “I’m not a robot” option and continue;
  • Then, continue to report the data requested by the Court to complete the request that justifies the absence from the vote. It is important to select that the justification is related to the election of Municipal Elections 2020 – 2nd round;
  • Subsequently, it is necessary to justify the reason for the absence in the vote. In addition to the written part, a document will be requested proving the reason for the absence, such as a medical certificate, travel tickets and other proof of the type;
  • The last step is to download the receipt generated by the Court system.

I pay a fine?

The voter who does not justify must pay a fine of R $ 3.51 for each round. In case of absence in the first and second round, the voter must present the justification for each one. In addition, the TSE indicates the consequences for those who do not justify them. They are:

  • Get passport or identity card
  • Participate in public contest
  • Have public income, compensation, salary or employment.
  • Obtaining loans from public agencies
  • Participate in a public service contest or test
  • Perform any act that requires the fulfillment of military service or income tax
  • Obtain electoral registration certificate

The orientation of the TSE is to present the justification by the electronic title, the Justification system or to send the Electoral Justification Request form and the supporting documentation of the absence, by mail, to the judge of the electoral zone in which it is registered within 60 days after each change. You can also present the justification within 30 days from the date of return to Brazil.

For those registered in the Foreign Electoral Zone (ZZ) who wish to be absent from the polls, the orientation is the same. The TSE establishes that the supporting document can be delivered to diplomatic missions or consular offices located in the country where the voter is located within 60 days after each round.

According to the guidelines of the Electoral Justice, to justify the absence of the ballot boxes, in the specific case of Covid-19, it is necessary to have a document such as a certificate, medical statement or proof that proves the infection.

Additionally, the court orders the voter to stay home if they have a fever on voting day or contracted Covid-19 in the 14 days prior to the second round.
