BRASÍLIA – On his Facebook account, President Jair Bolsonaro wrote on Sunday that Judge Kassio Marques, elected to be a minister of the Federal Supreme Court (STF), is fully aligned with him. According to the president, the judge is against abortion, in favor of bearing arms and defends the family. The message was a response to a netizen who wrote “The next nomination of the president to the STF indicates squid” (sic).
In the first response, Bolsonaro explained that Lula does not meet the age requirement to be appointed to the Supreme Court. “She is over 65 years old. Study and find out before accusing people ”. Later, he said that the election of Kassio Marques is “completely without return.”
“Kassio is against abortion (he will vote against ADPF 442 if it passes). He is an arms professional within the limits of the law (he is CAC). He defends the family and the economic guidelines (who doubts that he awaits the votes). In short, he is 100% aligned with me, which is why the campaign to deconstruct him, ”Bolsonaro wrote.
ADPF 442 is the pending lawsuit before the STF that requests the decriminalization of abortion. There is no prediction of when it will be judged.
Referral does not guarantee loyalty
Historically, the actions of the STF ministers have shown that the appointment of the President of the Republic is not a guarantee of fidelity. Appointed by former President Lula, Dias Toffoli voted in May 2018 against a habeas corpus filed by the former president’s defense, who had already been arrested a month earlier for his conviction in Operation Car Wash in the case of the Guarujá triplex.
First appointed by then-President Dilma Rousseff, Minister Luiz Fux, now President of the Court, voted together with the rapporteur of the lawsuit on the monthly allowance, Joaquim Barbosa, to convict most of the defendants, including the heads of the PT , as directed by former minister José and former party president José Genoino.
In late 2015, Edson Fachin was selected as the rapporteur for a story that would set rules on the impeachment rite of then-President Dilma Rousseff, who had appointed him to the position.
