As a result, there was no impediment to the eviction of the 52 illegal facilities from that point on the beach, the lawyers said.
A virtual appeals bank of four judges headed by the Chief Justice approved the order on Thursday after hearing appeals from the Land Ministry and the state seeking to overturn the order from the higher court.
Cox’s Bazar Deputy Commissioner after court order. Kamal Hossain said they will soon take the initiative to vacate a facility.
Lawyer Manzil Morshed appeared for the Ministry of Lands in the High Court. Assistant Attorney General Biswajit Debnath appeared for the state. Lawyer Mahbub Uddin Khokon heard the order petition from 52 people.
In February 2016, 52 licensees from Cox’s Bazar Township started their business with the construction of various facilities at Sugandha Point in Kalatali on the beach.
Two months after the facility was constructed, that is, on April 10, 2016, the Cox’s Bazar Development Authority issued a notice to remove the facility.
When the 52 people filed a judicial petition in Superior Court challenging the validity of the notice, the court granted the stay on April 16 along with the rule.
The land ministry and the state then appealed to the appeals division against the Superior Court order. After hearing the appeal, the higher court overturned the suspension order and the higher court rule.
Attorney Manzil Morshed told bdnews24.com, “I received the court order a long time ago to protect the beauty of the beach. In 2011, all illegal facilities were removed from the beach.
Subsequently, the Appeals Division issued a more difficult verdict regarding the environment as a crisis area. The court also ordered the demolition of large illegal structures ”.
Even then, some ‘selfish people’ have ruined the beach’s beauty and established the facilities with a business license from the municipality, he said.
“After the matter came to our attention, a request was made to the Appeals Division. After the hearing, the Appellate Division overturned the Superior Court order. “
When asked about the role of the administration, Manzil Morshed said: “I have a question, why is the administration blindfolded? The administration knows that there is a court order and there is a verdict. And why is the municipality to them! I would give a license! “
The Supreme Court attorney said the municipality would take “legal action” against those who issued business licenses to the 52 people.
Retired Lt. Col. Forkan Ahmed, Chairman of the Cox’s Bazar Development Authority, told bdnews24.com that these legal and illegal establishments were being established in the beach area through the deputy commissioner.
“Although the development authorities evicted these establishments, the land is owned by the district administration. This is a special place. The responsibility for the khas place rests with the collector. And the collection is DC, Ministry of Lands.”
Therefore, the administration will have to take strict action after removing these illegal facilities, he said.
“If we don’t do it together, I’ll give it away; Remote. But if the district administration cannot hold back, do not arrange to do otherwise; Then these problems will happen. “
In this regard, Deputy Commissioner Kamal Hossain said that he has learned of the order issued against the eviction of 52 structures on the beach and the order to dismiss the suspension order through a lawyer.
“Once the court order is received, eviction arrangements will be made to implement it quickly.”
