BEC issued the Note “on the measure of classification of requests for recount and notifications received by the Central Electoral Office of the constituencies whose centralization records of the voting results were received by the Central Electoral Office under the conditions of art. 39 par. (1) on. g) of Law 115/2015, with subsequent modifications and completions ” in which it says:
“Considering the provisions of article 95 of Law No. 115/2015, with subsequent modifications and completions, which relegate the procedure for challenging voting operations, opening the polls, counting and totalizing the votes , as well as recording the result of the vote in the minutes,
Seeing the procedure for drafting, verifying and delivering the act of the electoral results provided by Decision BEC no. 98/15/09/2020,
noting that the requests for a “recount” of votes from the electoral districts whose minutes relating to the centralization of the voting results were received by the BEC under the conditions of art. 39 par. (1) on. g) of Law 115/2015, with subsequent modifications and completions, was left without purpose,
based on art. 9 par. (1) and art. 19 let. e) of the Regulation on the organization and operation of the electoral offices enabled for the local elections of 2020, as well as the order of the president of the AEP 483/2020 on the appointment of the employees of the AEP who work in the auxiliary technical apparatus of the BEC, established in the elections of authorities of the public administration local authorities from 2020, we propose the following:
1 The classification by the president of the BEC, at the proposal of the head of the legislative department of the AEP, of the requests and notifications of “recount” received by the BEC, in relation to the districts whose minutes on the centralization of the results of the votes were received by the BEC by virtue of art. 39 para (1) lit. g) of Law no. 115/2015, with subsequent modifications and completions;
