The Bacău Court decided to overturn the decision of the County Committee for Emergency Situations to close the county’s restaurants and bars. The unprecedented court decision is not final.
The process was opened by about 20 companies in the scope of HoReCa, who requested the annulment of the decision of the Committee of Emergency Situations of the County of Bacău to close the restaurants and bars of the county.
Decision of the Bacău Court, Civil Section II and contentious administrative and tax:
- “Cancels paragraph 7 of article 2 of the decision of the Committee on Emergency Situations of Bacău County, No. 44 of October 15, 2020. Suspends paragraph 7 of article 2 (…) until the final resolution of the case. the accused to issue another HCJSU that includes gradual measures to combat Covid19 for the HoReCa industry, with the right of appeal within 15 days of the communication of the cancellation request and 5 days of the communication of the suspension.
