The Senate approved, this Monday, a bill initiated by the parliamentarians of the PNL and the USR that aims to repeal the regulation that allowed the early retirement of judges and prosecutors. The current law initiated by the PSD allowed magistrates to retire at the age of 45 and after serving 20 years.
According to the explanatory memorandum, the regulation by which the repeal was requested would have had the effect, in the short term, of retiring a significant number of judges and prosecutors, a situation of great impact on the proper functioning of courts and prosecutors . . Likewise, due to the insufficient number of magistrates, the efficiency and quality of the act of justice will be jeopardized, as well as the observance of the principle of resolving cases within a reasonable time ”.
The Senate Legal Commission analyzed the legislative proposal for the modification of GEO no. October 92/15, 2018 for the modification and completion of some normative acts in the field of justice, together with the legislative proposal L84 / 2020 to repeal the provisions that regulate the possibility of early retirement of legal personnel of the judicial system ” , in the provisions of article 1, petition 142 of Law No. 242/2018, with reference to article 82 paragraph (3) of Law No. 303/2004 on the status of judges and prosecutors, reissued, with subsequent modifications and completions ” .
The senator of the PNL Alina Gorghiu affirms that by repealing the legislative initiative on the early retirement of the magistrates of the PNL, it achieved an important objective in the Justice chapter, “to fix” what the jurists indicated “negatively” in the reports of the MCV, in the Venice documents. He added that the magistrates under the age of 60, “were put in a position to retire now because of this favor that the PSD introduced into the law, but not because they cared about the way the magistrates work, but to favor them in the anticipated situations. for them “.
