The traffic police carry out routine control actions from time to time. In addition to checking the legality of the documents, they can also involve checking the accessories that we never want to use, that is, a first aid kit, two reflective triangles and a fire extinguisher.

Regarding the verification of the documents that are necessary for drivers on public roads, the police will take into account the documents of the car (check) as well as the documents of the car driver (driving license and identity card).

According to Chapter V – Traffic Regulations of the Highway Code – Emergency Ordinance no. 195/2002 on traffic on public roads, “traffic participants are obliged, at the request of the traffic police, to hand over their identity document or, where appropriate, the driving license, the registration document or the license plate of the vehicle driven, the documents related to the merchandise transported, as well as other documents provided by law ”.

Failure to comply with these provisions leads to drivers a fine of the third class of sanctions that provides between six and eight penalty points. This penalty will be between 870 lei and 1,160 lei, in the context in which the value of the fine of 145 lei is valid until December 31, 2020 in the absence of other express changes. The value of 145 lei is valid since the beginning of 2017, when the gross minimum wage per economy was 1,450 lei.

For “refusal to deliver the identity document, driving license, registration certificate, other documents provided for by law, at the request of the traffic police, as well as the refusal to allow the vehicle to be verified” a penalty of 4 is applied penalty points.

In Romania there are five kinds of fines, the first four apply to individuals, while the fifth applies only to legal persons. Thus, the maximum fine for individuals (20 penalty points) is 2,900 lei, while for legal persons the maximum fine (100 penalty points) is 14,500 lei.

The kinds of sanctions are:

  • class I: 2/3 fine points;
  • second class: 4/5 points-fine;
  • third class: 6-8 points-fine;
  • 4th grade: 9-20 penalty points;
  • 5th class: 21-100 fine points.

On the other hand, the medicine cabinet, the fire extinguisher or the reflective triangles can carry you fines either if you do not have them all or if they do not comply with the law. This error of the drivers falls into the second class of penalties with four or five penalty points, so the fine will be 590 lei or 725 lei.

According to Order no. 987/2007 for the approval of the minimum content of the car’s sanitary kit:

The packaging of the car sanitary kit must meet the following conditions:

a) ensure an adequate seal to protect the content from dust, moisture, fuels and oils, by means of a firm closure system;

second) be sized accordingly, to store and ensure the integrity of the components of the automotive sanitary kit content.

The car kit label must contain the name of the product, the name and address of the manufacturer, and the name and address of the person responsible for marketing the product, as appropriate.

At the expiration of the term of validity of the components of the car sanitary kit, the user may replace them with products of the same characteristics, introduced on the market in compliance with the requirements provided by Government Decision no. 911/2005.
