The Bacău court decided to partially overturn the decision of the County Committee for Emergency Situations on the measures taken to prevent the spread of the coronavirus. The decision refers only to the closure county restaurants and bars and it’s not final.
The judges decided to annul “art. 2 par. 7 of the Bacău County Committee for Emergency Situations Decision No. 44 dated 15.10.2020. Suspend art. 2 par. 7 (…) until the final resolution of the case. It obliges the defendant to issue another HCJSU that includes gradual measures to combat COVID-19 for the HoReCa industry ”.
The Bacău Court decision came after the county’s HORECA representatives challenged in court the decision that included restrictions on them.
“What I said during the meeting with the representatives of HORECA, on October 12, came true: any decision, including that of the Regional Committee for Emergency Situations, is questionable, especially when it shows clear signs of abuse, flight from responsibility by the authorities. ” and heroic approaches, evidently counterproductive, with the worst consequences. The Bacău Court ordered (…) the annulment of a part of CJSU decision no. 44 / 15.10.2020, at the same time forcing the CJSU to issue a new decision containing gradual measures to combat the pandemic in relation to the local HORECA industry, ”said Valentin Ivancea, president of the Bacău City Council.
Valentin Ivancea stressed that he proposed at the CJSU meeting from that moment to take gradual measures, he agreed with the HORECA representatives, but his request was not taken into account.
“It is a first great step towards respecting the rights of these entrepreneurs, but also to develop a coherent and effective plan of anti-COVID-19 measures, which will not lead to the bankruptcy of local companies and therefore hit by the pandemic . I am glad that the HORECA representatives understood, in the discussion I had in mid-October, that only by acting in a consistent, unitary manner can I obtain results.
