Romania’s first decision to cancel Sunday’s elections: Electoral Office cancels elections for mayor of Moldova Nouă – Politics

The Central Electoral Office (BEC) decided to cancel the elections for mayor of Moldavia Nouă in Caraş Severin county and resume the elections, after finding the nullity of the candidacy of Adrian Constantin Torma (PSD), voted for 48.42% of those who-went to the polls BEC found that the Moldavia Nouă District Office accepted the candidacy of Adrian Torma from PSD-Pro Romania, although the Caras Severin Court had previously rejected his candidacy, as the document was not signed by the local leaders of PSD and Pro Romania, according to the law.

The elections for the post of mayor of Moldova Nouă will resume on October 11, following a decision taken by the Central Electoral Office, prior notification of PNL Caraş Severin and PNL Moldova Nouă, writes News.ro.

PNL denounced the fraud of the electoral process in 11 polling stations in the town, but also the fact that the Social Democrat Adrián Constantin Torma, candidate for mayor, illegally entered the electoral race, since his candidacy had been rejected by judicial decision.

According to data published on the website of the Permanent Electoral Authority, Adrian Constantin Torma, supported by PSD and Pro Romania, was voted by 48.42% of those who went to the polls, while the liberal candidate Ion Chisăliţă was voted . 46.23% of voters.

After scrutinizing the votes, the BEC declared the candidacy of the PSD and the Pro Romania candidate void due to the existence of a decision by the Court of Caras Severin in this regard, a decision of the magistrates because the document representing Torma’s candidacy was not endorsed by the organizations local. PSD and Pro Romania, this being, in fact, a substantive requirement provided by law.

  • “The Central Electoral Office concludes that Mr. Torma Adrian Constantin has applied for the post of mayor of Moldova Nouă, although, by means of a final judicial decision, issued in accordance with article 54 of Law No. 115/2015 and that he benefits of the res judicata authority, his candidacy had been definitively rejected due to the cumulative breach of the legal conditions (…) Such participation of the PSD-Pro Romania Electoral Alliance in the electoral competition was possible because this electoral competitor insisted and obtained the admission of the candidacy of Mr. Torma Adrian Constantin for the post of mayor of Moldavia Nouă in the 2020 local elections after the final decision of the court and ignoring its effects, in clear violation of the provisions of article 54 of the Law No. 115/2015 and without fulfilling the conditions to be able to apply until 18.08.2020, when the period of presentation of the candidatures ends ”, shows the BEC in the decision to cancel the election.

Although the president and the deputy of the Electoral Bureau, but also the representatives of the PNL and USR issued a separate opinion on the decision by which the Electoral Bureau of the Electoral District of New Moldova admitted the candidacy of the Social Democrat, he still entered the electoral race and was elected mayor.
