On 20 October, another Bacău man had complained to the police that an unknown person had physically assaulted him and stolen 50 euros from his jacket pocket. The police opened a robbery case.

R., 17, and B., 20, were brought to hearings at the Bacău Municipal Police headquarters on November 12, 2020. The two were interrogated for hours, without being allowed to ask for a lawyer . and without being told in what quality they are heard.

“They took us out of work, without specifying the reason or the quality for which they took us out,” the two say in the criminal complaint made later.

At the police headquarters they also saw S., an acquaintance of his, who would later be found out – and it also appears from the audio recordings published by Ziarul de Bacău – that he was the main suspect in the robbery case.

“Either you continue to be a witness or you leave as a co-author. You decide”

At the beginning of the interrogation, one of the young men, R., presses the registration button on his phone (without the police knowing). In the next two hours and 36 minutes, the phone would detect numerous abuses committed by police officers in an attempt to solve the case of the stolen 50 euros.

In the first half hour, the two law enforcement officers try to persuade R. to provide information about the robbery, telling him that he only has two options: be a witness or co-perpetrator of the crime.

All I care about is that. Either you remain a witness, or you leave as a co-author, you decide (…) Who are the perpetrators, will be arrested, who are the witnesses go home. Either you go home or we arrest you (…) B. is also here, so one of you will go to court.

Police to the minor (minute 15.50, of the recording):

On camera, R., B. and S. are seen together just before the robbery. But cameras do not capture the robbery itself, which took place under a bridge in Bacău County.

In the first part of the interrogation, the two policemen try to convince him “with the beauty” – negotiating the position of witness and with veiled or direct threats to R. to give information about the robbery.

The police officer to the minor witness: “You have a way to escape, but we have to put B …” (1 minute, 9 minutes, on the recording).

After R. says, several times, that he did not participate in the robbery and does not know what happened, the police lose their patience. After about an hour (recorded, at 1:11:15), one of them explodes:

The minor, almost whispering: I did nothing.

The policeman begins to beat the witness hard, the sounds of the blows are heard in the recording.

Policeman: I pray all day for you, me? What a day !! Day!! Day!! Day! (yells at witness several times) I would fuck myself up, fuck up the nation, hug me like a crow!
Slight and deep voice: Ready, boss, ready.

policeman: How are you? Day (screams)
less: That’s right, I’m talking now, I’m talking now.

policeman: Day.
less: This one stole the money. (After the beatings, the minor says for the first time that he knows who the author of the robbery is).

policeman: Who is this?
less: This is.

policeman: How did you steal your money?
less: He hit it.

When it comes to questions about how the money was distributed, the police are unhappy again, because R. says he did not receive money after the robbery, so within 10 minutes of the first beating, the second occurs, along With another shower of oaths

Threats of violence are only interrupted by actual violence.

Policeman: Fuck, I’ll give you one to break your head.
less: Don’t give it to me, please.

The recording shows one of the policemen repeatedly beating the minor in his custody, while showing him images from the recording that contradicted the minor’s earlier statement.

Policeman: Well, handicapped, how can you say not?
less: All right, boss, don’t give up, please.

Policeman: I no longer give But you keep lying, right?
less: I’m not lying, boss. (The child is beaten again.) I tell you the truth, let me die.

Sprayed with water and humiliated during questioning

A few minutes later, B, the 20-year-old man, was brought into the room, brought to the hearings with R.

Law enforcement asks B. questions to confirm R.’s version, but during this time they also spray him with water, and these sounds appear in the audio. And then B. gets punched.

Arguments between police officers show that the lack of lawyers was intentional

R.’s phone stays with one of the policemen and also captures discussions in which he does not participate. This dialogue shows that the police did not know in what capacity they had brought the minor to the police station, but also that they intentionally wanted to hear him in the absence of a lawyer, until the young people’s statements said the same.

One of the law enforcement officers tells the other to call the prosecutor, only after they have completed the youth statements.

“Why shouldn’t I show you?”

“The point is that there will be more contradictions between them and they cannot be resolved if they have a lawyer.”

A few minutes later, the dialogue between the police continues:

– Take and make cosmetics and teach them: fools, I brought you as a witness and you go home, and when you see the standardized witness statement, you go home.
“Anyway they are heard as witnesses.” Because in fact and in law, the author is different, not that one, you understand? (…) If he testifies, he will say that he heard them (…) he said: yes, we don’t take care of him.

Towards the end of the recording (2:33:00), R. signs the technical statement edited by a policeman without being allowed to read it first.

R. is allowed to leave after three hours of hearings and remains a witness in the case. B. is detained for questioning for 10 hours, until 8 pm, when S. and B. are detained as suspects for 24 hours.

R. and B.’s attorney filed a criminal complaint against police officers for influencing statements, beatings and other acts of violence, abuse of power, abusive investigation, and unjust repression.

According to B., the 20-year-old had been handcuffed at the hearings before being told he was a suspect.
