The director of the Municipal Hospital Odorheiu Secuiesc, the former director of the Hospital for Infectious Diseases of Brasov, several hospital employees, a police officer and local councilors are among the 12 people arrested for ADN in the case of award of contracts for which hospitals organized formal procedures for a certain company to be named the winner. For example, a former county councilor is accused of receiving a bribe of 25,000 euros, and instead the Hospital for Infectious Diseases Brașov bought an ultraviolet disinfection robot with 949,620 lei, since the market value of the product was included between 285,000 lei and 380,000 lei.

DNA announced on Friday that in this case, investigated by the Brașov Territorial Service, 12 people were arrested:

  • Delia Ramona Ionescu, at the time of writing, manager of the Hospital for Infectious Diseases of Brasov, for abuse of office if the official obtained for himself or another an undue benefit,
  • Oana Gabriela Olaru, at the time of the financial director – accountant act within the Brașov Clinical Hospital for Infectious Diseases, for abuse of office if the official obtained for himself or for another an undue benefit,
  • Gheorghe Nedelea, at the date of the event, a specialized reference of the Bra delov Clinical Hospital for Infectious Diseases, for committing the crime of complicity in abuse of office if the official obtained an undue benefit for himself or another,
  • Kadas Iluna Marius Andrei, at the time of the events, county councilor and chairman of the health, child and adult protection commission of the Brașov City Council; President of the Board of Directors of the Bra Clínov Infectious Diseases Clinical Hospital, for influence peddling, incitement to abuse of office if the official obtained an undue benefit for himself or another,
  • Marius Cristian Popa, councilor of Săcele, for complicity in influence peddling,
  • Emanoil Mirică, police officer of the Brașov Special Operations Brigade within the General Inspectorate of the Romanian Police – Directorate of Special Operations, for using, in any way, directly or indirectly, information that is not intended for publicity or to allow access unauthorized to this information, compromising the interests of justice, accepting bribes (4 material acts), influence peddling (5 material acts),
  • Antal Lukacs, manager of the Odorheiu Secuiesc Municipal Hospital, for three crimes of abuse of office with obtaining undue benefits, three crimes of accepting bribes, buying influence,
  • Eniko Balint, referring to the Public Procurement Service of the Municipal Hospital Odorheiu Secuiesc, for three crimes of abuse of office with obtaining undue benefits, four crimes of bribery, use, in any way, direct or indirect, of information that is not intended to advertising or to allow unauthorized access to such information,
  • Laszlo Barczan, at the time of the events as a shopkeeper at the Odorheiu Secuiesc Municipal Hospital, for abuse of office if the official obtained for himself or another an undue benefit on a continuous basis (2 crimes), bribery (2 crimes),
  • The administrator of a company, for four crimes of bribery, instigation of two crimes of abuse of office with obtaining undue benefits, influence peddling, two crimes of buying influence, complicity in abuse of office with obtaining undue benefits, favoring the perpetrator,
  • The driver of the employer, for complicity in abuse of office if the official obtained for himself or for another an undue benefit, continuously,
  • Accountant within SC Chantel Sante SRL, for complicity in abuse of office if the official obtained an undue benefit for himself or for another, continuously, complicity in instigating abuse in the position if the official obtained improper use for himself or for another (2 offenses, both committed continuously).

In the same case, SC CHANTEL SANTE SRL is prosecuted for four crimes of bribery, purchase of influence and complicity in abuse of office with obtaining undue benefits, two crimes of instigating abuse of office with obtaining undue benefits.

According to DNA, the investigation refers to the alleged fraudulent allocation, by those responsible for some hospitals in Brașov and Harghita counties, of contracts through which the units would have bought overpriced medical equipment and products, some of which did not comply with the compliance conditions and others not. they were necessary.

In order to award preferential contracts paid for with public money, the hospitals in question allegedly organized formal procedures by which a certain company was designated as the winner.

On the other hand, those responsible for hospitals and / or people with ancestry and influence over them would have received sums of money from the company’s legal representative.

Processes:

  • 1. Between October 2019 and September 2020, Kadas Iluna Marius Andrei, in the aforementioned capacity, allegedly received from an entrepreneur who controlled SC Chantel Sante SRL, directly the amount of 5,000 euros and indirectly, through him. Popa Marius Cristian, the amount of 20,000 euros (of which the latter would have left a part) to exert the influence that he claimed to have on the decision-making officials within the Braşov Clinical Hospital for Infectious Diseases.
  • The influence would have been real because, on February 18, 2020, the hospital unit concluded with the businessman’s company, whose main object of activity was the wholesale trade of pharmaceutical products, a contract for the purchase of a robot for disinfection with ultraviolet light , which amounts to 949,620 lei with VAT (given that the market value of the product was between 285,000 lei and 380,000 lei).
  • Subsequently, on April 10, 2020, the Brașov Clinical Hospital for Infectious Diseases made to SC Chantel Sante SRL, the full payment of the equivalent value of the robot mentioned above.
  • From the evidence provided so far, it can be inferred that the purchase contract was awarded to the company in a fraudulent manner, with the direct participation of the suspects Ionescu Ramona Delia, Olaru Oana Gabriela and Nedelea Gheorghe, since the investment was not necessary , was greatly overestimated, and commissioning of the robot has not been achieved so far.
  • In the aforementioned context, the anti-corruption prosecutors ordered, in this case, the carrying out of some procedural activities by the police officers of the IGPR – Brașov Special Operations Brigade.
  • On this occasion, after Mirică Emanoil, in the aforementioned capacity, knew exactly, in the manner described above, the aspects investigated and the people involved in the investigation, they had communicated this information to the employer, making it difficult to process the case. .
  • For these “services”, but also in exchange for the promise to use the influence he claimed to have with the police officers and prosecutors of the ADN – Brașov Territorial Service to learn more details about the investigation, the suspect Mirică Emanoil would have received from the businessman various improper benefits (money, food and dental interventions).
  • 2. In a similar context, between April 10 and December 2, 2020, Lukacs Antal, manager of the Municipal Hospital Odorheiu Secuiesc, in violation of the legal provisions on public procurement, would have approved the celebration, with the same company businessman, of several contracts that had as object the purchase, by the respective hospital, of some medical products (paid in full until now).
  • The suspects Balint Eniko and Barczan Laszlo, a reference within the Public Procurement Service, and a shopkeeper at the Odorheiu Secuiesc Municipal Hospital, who would have prepared some of the documents and allowed the employer to do so, would have had an important contribution to these procedures. , through its two employees (the driver and the accountant) have access to the confidential information contained in the offers presented by other economic operators.
  • It should be noted that some of the products were purchased without this being required in relation to the needs of the hospital unit (for example, branules that already existed in stock in sufficient quantity for six months and other consumables destined for a part of the hospital that still had not been completed).
  • Each time, all the prices of the ordered products would have been overestimated.
  • During the same period, the suspect Lukacs Antal, in exchange for making priority payments to SC Chantel Sante SRL, allegedly asked the businessman to use the influence he allegedly claimed to have over the management of the National Authority. Quality Management in Health, in order to obtain the level of accreditation corresponding to the second class, although the hospital only met the conditions required by law for the granting of the third class.
  • For the steps described above, the businessman allegedly promised and delivered to the two suspects sums of money and other benefits as follows:
  • – Lukacs Antal would have received the total amount of 10,000 euros and would have accepted the promise to remit a percentage of 20% of the value of certain contracts valued at 2,136,706 lei, equivalent respectively to 89,000 euros
  • – Balint Eniko and Barczan Laszlo have received and accepted the promise of improper remittances and benefits, not quantified until now.
  • Through these efforts, the suspects allegedly caused damages to the hospitals for a total amount of 1,669,234 lei, simultaneously with obtaining an undue benefit for the same amount for the company SC Chantel Sante SRL.
