PSD Senator Daniel Zamfir presented to the Senate, in emergency procedure, a bill that provides prison sentences of between 6 months and 3 years for ministers who repeatedly refuse to appear in hearings in specialized commissions, investigation commissions or in Parliament, reports news.ro.
The legislative initiative signed by 11 other Social Democratic parliamentarians modifies and complements Law 115/1999 on ministerial responsibility, introducing a new sub-point in article 8, paragraph 2, which also constitute crimes and are punishable by imprisonment from 6 months to 3 years the following acts committed by a member of the Government: „c) The repeated refusal to appear in the work of the permanent commission to which he is invited, within the activity of informing Parliament by the members of the Government, according to art . 111 par. (1) of the Romanian Constitution, republished ”.
Daniel Zamfir maintains that there have been “repeated situations in which members of the Government have systematically and unjustifiably refused to participate in the work of the permanent commissions or investigation commissions, although they have been repeatedly invited by both the commissions and the Chamber of Deputies. . and / or the Senate, by decision of the Permanent Bureau of the respective Chamber, the interinstitutional dialogue was jeopardized as well as parliamentary control over the activity of the Government.
He adds that legislative changes are needed to stop such behavior.
Therefore, to stop the perpetuation of this behavior, which leads to a total lack of transparency by avoiding parliamentary control, it is necessary to complement the current legislation, so that the presence of members of the Government in the Chamber of Deputies, Senate or permanent committees , special and special consultation to be guaranteed. In this sense, the current legislative proposal aims to complement Law 115/1999 on ministerial responsibility, so that the repeated refusal of the members of the Government to appear before the Permanent Commission to which the members of the Government are invited to report Parliament be sanctioned, ”says Daniel Zamfir in the explanatory memorandum of the bill.
The bill was registered on October 14 in the Senate, being the first notified forum, in an emergency procedure, the decision was the Chamber of Deputies.
