“Personally, I can agree that the school is an open space, but on the other hand, we are obliged to comply with the law,” said Jean Badea, noting that the school is not a private space, which must be protected, but a public space. What happens if one of the parents disagrees?
“I want you to understand that personal opinion does not matter here, insofar as the law explicitly regulates it: the lesson can only be recorded with the consent of both the teacher and the students. Beyond the identity of the teacher or beyond the teacher’s reluctance to have their lesson recorded, there is the possibility that the recordings include minors, who fall under the same type of legislation, ”says Jean Badea.
“If a parent refuses to sign the statement, nothing happens, these statements are by way of recommendation, their logic was to give additional confidence to the two categories involved in this process and to which parents should contribute equally. and teachers. There will only be consequences in the situation where the lesson is recorded and these recordings are made public and one of those targeted complains about this aspect, ”explained the Ministry of Education official. But, according to regulations, a child cannot be registered, added Jean Badea.
He stressed that the Ministry of Education has not legislated in this regard and as long as European legislation prohibits it, the Ministry of Education cannot regulate otherwise than European legislation. “To the extent that there is a legislative possibility to regulate this, I assure you that we will do it, we have all the openness,” Jean Badea also told Digi24, declaring himself ready for “consultations” when the director of Digi24 said he will.
