A new law, which will take effect at the end of March 2021, will change the procedure for calculating the amount of the housing allowance awarded to adopters. If this allocation currently has a fixed value, starting in March it will increase due to the calculation formula that will change.

Thus, the amount received by the adoptive parents will be established according to the average net income of the last 12 months of the last two years prior to the date of issuance of the custody decision for adoption. Specifically, the current fixed amount will become a minimum and the allowance can be much higher.

The new calculation rule will be applied as of March 26, 2021, according to Law 268/2020, a regulatory act that appeared the other day in the Official Gazette.

«The amount of the monthly allowance (…) will be 85% of the average net income obtained in the last 12 months of the last 2 years prior to the date of the entrustment judgment for adoption. The amount of the monthly allowance cannot be less than the amount resulting from the application of a multiplication coefficient of 3.4 to the value of the reference social indicator (SRI, which is currently 500 lei – n. Red.), And its amount maximum cannot exceed the value of 8,500 lei ”, is shown in the aforementioned normative act.

Therefore, if the allowance is currently worth 1,700 lei, as of March next year, it can reach up to 8,500 lei.

In addition, according to the same normative act that was published in the Official Gazette these days, they will benefit from the license and accommodation subsidy granted to adoptive parents, including those who obtain income from copyright, a category that is not included in current legislation . In certain situations, people who benefit from the accommodation allowance may continue to receive the money, even if they obtain certain additional amounts during the withdrawal period.
