The National Authority for Consumer Protection (ANPC) has been monitoring the market for protection materials since the beginning of the state of emergency and alert caused by the Covid-19 pandemic, according to a statement.

Masks worth 3.65 million lei were reviewed, finding deviations in personal protective equipment (PPE), which amounts to 2.1 million lei (approximately 58%). As a consequence of the irregularities found, the ANPC commissioners ordered the application of 382 sanctions, of which 114 reprimands and 268 fines for infringement, for an amount of 1.75 million lei for violating consumer protection regulations. Complementary measures were added to these, consisting of the temporary cessation of the sale of more than 31 million masks and the definitive cessation of the sale of more than 90,000 masks.

During the control actions, a series of deviations were found, among which the total or partial lack of informative elements-characterization on the product label, lack of inscription of instructions for use, lack of mention of the composition of the material used. , lack of translation into Romanian of the information and instructions on product labels, lack of indication of identification and characterization elements, regarding the name of the manufacturer / importer / distributor and the address in Romania, lack of CE marking, lack declaration of conformity, lack of indications on special storage and / or handling conditions and / or non-compliance, lack of information on the maintenance of PPE, lack of batch or serial number or other element to identify the mask – PPE, lack of mask size record – PPE, marketing of unsafe products (inside the box, the masks were not in packaged).

ANPC also found that there are elements that can mislead the consumer about the legality of the product: the declaration of conformity stated that the mask product was a medical device and the test report was issued for a PPE that is subject to another legal framework ; affixing the CE marking by non-accredited bodies; place the CE marking on the products “washable hygienic masks” and “washable hygienic masks for children” that indicated on the label that “they do not belong to the group of personal protective equipment or group of medical devices” in the declaration of conformity indicating the Law no. .245 / 2004; inconsistency between the name of the product and the information on the packaging and in the declaration of conformity issued by the manufacturer; instructions for use other than those listed in the technical sheet, presenting the product as a type II medical device, even if the documentation indicates type I. The product had the CE marking without the manufacturer being able to present a document issued by a body of conformity assessment; unfair business practices; lack of display or non-compliant display of prices.

RAPEX notifications of masks from Member States were also taken into account in the control actions. In this context, products notified through the RAPEX system were found on the market, the marketing of which was permanently suspended.

Due to the large number of masks on the market, controls in this area continue throughout the country until the end of the alert.
