Parliament voted on Wednesday to establish a state of alert, which comes with a new set of rules that Romanians will have to follow in the coming period, but also with new sanctions for those who violate them.
The law establishes fines for individuals and legal entities that start at 1,000 lei and can reach up to 15,000 lei. Fines can pay half the amount within 15 days.
Full list of fines:
Art. 65. – They constitute contraventions, insofar as they are not.
committed in conditions such as to be considered under criminal law offenses, the following acts committed during the state of alert:
a) the failure of the leaders of the social assistance services to take the measures established in accordance with art. 5 for. (1) lit. e), regarding the adaptation of the work schedule or the permanence of the activity – fine of 1,000 lei to 5,000 lei;
b) non-compliance by the heads of the authorities or institutions of
the level at which the operational centers for emergency situations are constituted, of the measures for the permanence of their activity, in accordance with article 5, paragraph (1) letter f) – fine of 1,000 lei to 5,000 lei;
c) non-execution of the measures established in accordance with article 5, paragraph (2), letter a),
on the temporary evacuation of people and property of the personnel of the institutions and public authorities designated to implement such measures or affected by them – fine of 500 lei to 2500 lei;
d) the impediment by any natural person of the execution
measures for the temporary evacuation of people and property from the affected or possibly affected area, established in accordance with Article 5 paragraph (2) letter a) – fine of 500 lei to 2500 lei;
e) the impediment by any natural person of the distribution
Basic aid for affected people and animals, established in accordance with Article 5 (2) (b) – fine of 500 lei to 2500 lei;
f) breach of the works established in accordance with article 5, paragraph (2), letter c),
regarding the emergency change of the environment and
infrastructure, by the staff of public institutions and the authorities designated by the decisions of the Emergency Committees to implement these measures: fine of 1,000 lei to 5,000 lei;
g) the impediment by any natural person of the performance
Works established in accordance with article 5, paragraph (2), letter c), on the emergency modification of the environment and infrastructure. fine of 500 lei to 2500 lei;
h) non-compliance by people with the measures
individual protection of life and to limit the effects of the type of risk produced in people’s health, established in accordance with article 5, paragraph (2) letter d) – fine of 500 lei to 2500 lei;
i) non-compliance by individuals with the measures of
home isolation established in accordance with article 5 paragraph (2) letter d) – fine of 1,000 lei to 5,000 lei;
j) breach of the prohibitions established in accordance with article 5, paragraph (3)
letter a), to organize demonstrations, demonstrations, processions, concerts or other type of meetings, in open spaces, or meetings of the nature of cultural, scientific, artistic, religious, sports or entertainment activities, in closed spaces – fine of 3000 lei to 15000 lei;
k) participation of people in demonstrations, demonstrations,
processions, concerts or other types of meetings, in open spaces, or in meetings of the nature of cultural, scientific, artistic, religious, sports or entertainment activities, in closed spaces, prohibited in accordance with Article 5 letter (3). a) – fine of 500 lei to 2500 lei;
l) the development by the organizers of some rallies,
demonstrations, processions, concerts or other type of meetings, in open spaces, or meetings of the nature of cultural, scientific, artistic, religious, sports or entertainment activities, indoors, in violation of the measures established in accordance with art. 5 pair. (3) letter a) – fine of 2,000 lei to 10,000 lei;
m) the movement of people, pedestrians or vehicles, in places
and, as the case may be, during the time intervals in which it has been prohibited or restricted in accordance with Article 5 (3) (b) – fine of 2,000 lei to 10,000 lei;
n) breach by individuals of the prohibition of
departure from the areas established in accordance with Article 5 paragraph (3) letter c), or violation of the time intervals in which the departure from these areas is allowed: fine of 500 lei to 2500 lei;
o) breach by people of the prohibition of
departure from the buildings, localities or geographical areas in which the quarantine was established in accordance with article 5, paragraph (3), letter c) – fine of 1,000 lei to 5,000 lei;
p) non-compliance by operators with the measures established accordingly
art.5 paragraph (3) letter d), about the restriction or prohibition
transportation by road, rail, sea, river, air or subway or violation of the time limits in which they are allowed: fine of 3000 lei to 15000 lei;
q) non-compliance by the heads of the institutions or
economic operators, the conditions established in accordance with article 5, paragraph (3) letter f), on the development of the activity of these economic institutions or operators: fine of 1,000 lei to 5,000 lei;
r) non-compliance by the heads of the institutions or
economic operators, of the measures established in accordance with article 5, paragraph (3) letter f), on the temporary suspension of the activity of these institutions or economic operators: fine of 2,000 lei to 10,000 lei;
s) breach of works for the partial or total demolition of
constructions, facilities or arrangements, the transfer / dismantling of some assets / mobile means or the controlled flooding of some lands, crops, plantations or forests, by natural or legal persons or
to staff of public institutions and authorities designated in accordance with article 5, paragraph (4), letter g) – fine of 1,000 lei to 5,000 lei;
ș) the impediment by any natural person of the performance
works for the partial or total demolition of some constructions, facilities or arrangements, the transfer / dismantling of some assets / mobile means or for the controlled flooding of some lands, crops, plantations or forests, established in accordance with article 5, paragraph ( 4) letter h) – fine of 500 lei to 2500 lei.
The amount of fines
Art.66 – The infractions foreseen in art. 60 are sanctioned as follows:
a) with a fine of 500 lei to 2,500 lei for the offenses set forth in art. 60 lit. c), d), e), g), h), k), m), n) and ș);
b) with a fine of 1,000 lei to 5,000 lei for the offenses set forth in art. 60 lit. a), b), f), i), o), q) and s);
c) with a fine of 2,000 to 10,000 lei the infractions provided for in art. 60 lit. l), r) and t);
d) with a fine of 3,000 lei to 15,000 lei for the offenses set forth in art. 60 lit. j) and p);
Who can apply the sanctions:
Art. 67. – (1) The verification of the infractions foreseen in art. 65 and
The sanctions provided for in article 66 shall be applied by NCOs and civil protection and fire officials with guidance, control and verification functions, namely, appointed by the inspector general.
(2) The finding of the offenses provided for in Article 65 and the request
The sanctions provided for in article 66 are made by:
a) labor inspectors, for the infractions foreseen in
art.65 letters a), q) and r);
b) control personnel within the Department to
Emergency situations, as well as NCOs and firefighters and officers
civil protection, for the offenses provided for in art. 65 lit. B C D),
e), f), g), h), i), j), k), l), m), n), o), s), ș) and t);
c) police officers and officers, non-commissioned officers and gendarmes,
the local police, for the infractions provided for in art. 65 lit. d), e), g), h), i), j), k), l), m), n), o), r) and ș);
d) the personnel of the public health directorates, to
the infractions foreseen in art. 65 lit. h) and i);
e) the personnel designated by the Ministry of Transport,
Infrastructure and communications, for the infractions foreseen in art. 65 lit. P);
f) traffic police officers and officers, for infractions
provided for in art. 65 lit. p), in relation to road transport.
Art. 68. – The infractions foreseen by the present law are
applicable the provisions of government ordinance no. 2/2001 on the legal regime of infractions, approved with modifications and terminations by Law no. 180/2002, with subsequent modifications and accessories.
Art. 69. – (1) The offender can pay, within the
no more than 15 days from the date of delivery or communication of the minutes, half the amount of the fine applied by the agent who determines the infractions provided by law.
