On October 6, 2020, the Plenary of the Constitutional Court, in the control after the promulgation, by unanimous vote, admitted the exception of unconstitutionality and ruled that Law No. the public domain of the state is unconstitutional, as a whole.

The 2010 law provided, among other things, the administration of the Constanța City Council, but also the Năvodari and Ovidiu local councils of an area of ​​1,077.22 ha in the Siutghiol lake basin, including the related water brilliance, in the public domain of the State and in the administration of the National Administration “Romanian Waters”. The same normative act stipulates the transfer in the administration of the Tulcea County Council of a land located in the public domain of the state and in the administration of the Administration of the Biosphere Reserve “Danube Delta”.

The decision is final and generally binding and is communicated to the two Houses of Parliament, the Government and the court that notified the Constitutional Court, respectively, the Court of Constanța.
