The World Health Organization warns that it will be a tough two months in the fight against COVID-19. The second wave of the pandemic is already hitting hard in countries like Britain and France. In Romania, today we have a dangerous record of more than 1,700 new cases. And school has just started, and local elections are approaching, which will be attended by millions of Romanians. To these we add the cold season. So let’s see if today’s infection log will be an exception or the beginning of a second wave, as perceived in other European countries.

At the same time, today, President Klaus Iohannis promulgated the law that stipulates that the diaspora will vote in the parliamentary elections in two days, respectively from December 5-6. But, at the same time, as the president of the PSD and the president of the AEP affirm, European states do not want to open polling stations on their territory, in the context of a pandemic, thus encouraging Romanians in the diaspora to vote by mail . So far, only 7,000 have registered for this type of voting.

In this delicate context, there is the possibility of returning to the state of emergency if things get worse, as the WHO warns, from a pandemic point of view.

Can parliamentary elections be postponed if we are in a state of emergency? Augustin Zegrean, former president of the RCC, explained by DCNews, which, according to article 63 of the Constitution “in the four situations – state of mobilization, war, siege or emergency – the mandate of parliamentarians will be extended by law, nor does it have to give law. Writes in the Constitution, the mandate is extended by right. The whole story is in the hands of the president, if the president declares a state of emergency, the elections are automatically postponed, while the state of emergency lasts, and can then wait up to three months from the expiration date of the mandate.

This is what article 63 of the Romanian Constitution provides:

(1) The Chamber of Deputies and the Senate are elected for a period of 4 years, which is extended by law in a state of mobilization, war, siege or emergency, until its termination.

(2) Elections for the Chamber of Deputies and for the Senate shall be held within a maximum period of 3 months from the expiration of the mandate or from the dissolution of Parliament.

(3) The newly elected Parliament shall meet, at the convocation of the President of Romania, within 20 days following the elections.

4) The mandate of the Chambers is extended until the legal meeting of the new Parliament. During this period, the Constitution cannot be revised and organic laws cannot be adopted, modified or repealed.

(5) The bills or legislative proposals included in the agenda of the previous Parliament will continue to be processed in the new Parliament.
