The current President of the Republic of Moldova, Igor Dodon, has decided to sue both Prime Minister Ludovic Orban and President Klaus Iohannis. He claims that the Romanian authorities participated in his defeat in the presidential elections.

About two weeks ago, Igor Dodon’s lawyer submitted a request regarding the finding that foreigners are involved in the electoral campaign for the presidential elections of November 1 and 15, 2020: the President of Romania, Klaus Iohannis, the first Romanian minister, Ludovic Orban and the president of the Christian Democratic Union of Germany, Annegret Kramp-Karrenbauer.

After analyzing the request presented by Igor Dodon’s lawyer regarding the finding of participation in the electoral campaign for the presidential elections of November 1 and 15, 2020 of the aforementioned persons, the magistrates of the Supreme Court of Justice (SCJ) they forwarded the document for examination to the Court. Chisinau.

On Thursday, November 26, the SCJ determined the jurisdiction of the Chisinau Court, Rascani headquarters, to judge the contentious administrative case, the lawsuit filed by Igor Dodon against the Electoral Council of the Chisinau municipal district no. 1 regarding the challenge of the administrative act and the verification of the fact of participation in the electoral campaign for the presidential elections of foreigners. Therefore, the application was sent for examination to the Chisinau de Chisinau Court of Appeal.

“However, the law establishes the jurisdiction in the dispute of the courts in question and cannot be modified”, is shown in the document issued by the representatives of the SCJ.

Taking into account that a first aspect of the fair trial is the administration of justice by “a court invested with law”, that is, one that has mainly jurisdiction clearly established by national legislation, the specialized panel for the examination of actions in litigation administrative authorities of the Supreme Court of Justice will resolve the negative conflict of jurisdiction, by determining the jurisdiction to examine and resolve the case proposed by the Court of Chisinau, headquarters of Rascani ”, the magistrates also said, according to Ziarul de Garda.

The judges stated that, in his request, Igor Dodon did not invoke clear claims, as well as the participants / defendants in the trial against whom he brought the action.

The magistrates’ decision could be appealed to the Supreme Court of Justice within one day of sentencing, through the Chisinau Court of Appeal, which happened.
