The law that regulates the state of alert, voted on Wednesday night in Parliament, also establishes the facts whose commission constitutes a contravention, as well as the fines for each case. The fines vary from 500 lei to 15,000 lei, and those who receive them can pay half of the fine applied within 15 days.

The infractions and fines were introduced by means of amendments to the Legal Committee of the Chamber of Deputies. They were detailed so as not to repeat the situation with the fines for the state of emergency, which were declared unconstitutional because they were too general, without being defined and individualized for each situation.

The law was voted by the Chamber of Deputies, the decision-making chamber, and will have to be enacted by President Klaus Iohannis. If you do not encounter any obstacles on this route, the law will take effect no later than Monday, May 18. The state of emergency instituted by the head of state ends on Thursday, May 14 at midnight.

Alert rapists

Article 60 – The following acts committed during the state of alert constitute crimes, insofar as they are not committed under conditions that are considered crimes under criminal law:

a) the managers of the social assistance services do not take the measures established in accordance with article 5, paragraph (2), letter e), regarding the adaptation of the work schedule or the permanence of the activity – fine of 1,000 lei to 5,000 lei

b) the failure by the heads of the authorities or institutions at which level the operational centers for emergency situations are established, of the measures to maintain their activity, in accordance with article 5 paragraph (2) letter f ) – fine of 1,000 lei to 5,000 lei

c) the non-execution of the measures established in accordance with article 5, paragraph (3), letter a), in relation to the temporary evacuation of people and property from the affected or possibly affected area, by the personnel of the institutions and public authorities designated to implement these measures – fine of 500 lei to 2,500 lei

d) the impediment by any natural person, of the execution of the temporary evacuation measures of the people and goods of the affected area or possibly of being affected, established in accordance with art. 5 paragraph (3) letter a) – fine of 500 lei to 2,500 lei

e) the impediment by any natural person of the distribution of first aid for affected people and animals, established according to art. 5 paragraph (3) letter b) – fine of 500 lei to 2,500 lei

f) breach of the works established according to art. 5 paragraph (3) letter c), regarding the emergency modification of the environment and infrastructure, by the personnel of public institutions and the authorities designated by the decisions of the emergency committees to implement these measures – fine of 1,000 lei to 5,000 lei

g) the impediment by any natural person to carry out the works established according to art. 5 paragraph (3) letter c), regarding the emergency modification of the environment and infrastructure – fine of 500 lei to 2,500 lei

h) Non-compliance by individuals with individual measures for the protection of life and to limit the effects of the type of risk produced in people’s health, established in accordance with art. 5 paragraph (3) letter d) – fine of 500 lei to 2,500 lei

i) failure by individuals to comply with the home insulation measures established in accordance with art. 5 paragraph (3) letter d) – fine of 1,000 lei to 5,000 lei

j) breach of the prohibitions established according to art. 5 paragraph (4) letter a), to organize demonstrations, demonstrations, processions, concerts or other type of meetings, in open spaces, or meetings of the nature of cultural, scientific, artistic, religious, sports or entertainment activities, in spaces closed – fine of 3,000 lei to 15,000 lei

k) participation of natural persons in demonstrations, demonstrations, processions, concerts or other types of meetings, in open spaces or in meetings of a cultural, scientific, artistic, religious, sports or entertainment nature, in closed spaces, prohibited in accordance with art.5 paragraph (4) letter a) – fine of 500 lei to 2,500 lei

l) Organizers, demonstrations, demonstrations, processions, concerts or other types of meetings, held in open spaces or meetings of a cultural, scientific, artistic, religious, sports or entertainment nature, indoors, with non-compliance with the measures established according to the art. 5 paragraph (4) letter a) – fine of 2,000 lei to 10,000 lei

m) the movement of people, pedestrians or vehicles, in the places and, as the case may be, in the time intervals in which it was prohibited or restricted according to art. 5 paragraph (4) letter b) – fine of 500 lei to 2,500 lei

n) breach by people of the prohibition to leave the areas established in accordance with art. 5 paragraph (4) letter c), or violation of the time intervals in which it is allowed to leave these areas – fine of 500 lei to 2,500 lei

o) breach by people of the prohibition to leave the buildings, localities or geographical areas where the quarantine was established in accordance with art. 5 paragraph (4) letter c) – fine of 1,000 lei to 5,000 lei

p) breach by the operators of the measures established according to art. 5 paragraph (4) letter d), regarding the restriction or prohibition of transportation by road, rail, sea, river, air or subway or violation of the time intervals in which they are allowed – fine of 3,000 lei to 15,000 lei

q) non-compliance by the heads of institutions or economic operators, with the conditions established in accordance with art. 5 paragraph (4) letter f), on the development of the activity of these institutions or economic operators – fine of 1,000 lei to 5,000 lei

r) non-compliance by the heads of institutions or economic operators of the measures established according to art. 5 paragraph (4) letter f), on the temporary suspension of the activity of these institutions or economic operators – fine of 2,000 lei to 10,000 lei

s) the non-execution of works for the partial or total demolition of some constructions, facilities or arrangements, the transfer / dismantling of some assets / mobile means or the controlled flooding of some lands, crops, plantations or forests, by natural or legal persons or by the personnel of the institutions and public authorities designated in accordance with art. 5 paragraph (4) letter g) – fine of 1,000 lei to 5,000 lei

prevenir) prevent by any natural person, the carrying out of works for the partial or total demolition of some constructions, facilities or arrangements, the transfer / dismantling of some goods / mobile means or for the controlled flooding of some lands, crops, plantations or forests , established in accordance with art. . 5 paragraph (4) letter h) – fine of 500 lei to 2,500 lei

Fines for alertness

61 – The offenses provided for in article 60 are sanctioned as follows:

a) with a fine of 500 lei to 2,500 lei for the offenses set forth in art. 60 lit. c), d), e), g), h), k), m), n) and ș);

b) with a fine of 1,000 lei to 5,000 lei for the offenses set forth in art. 60 lit. a), b), f), i), o), q) and s);

c) with a fine of 2,000 to 10,000 lei the infractions provided for in art. 60 lit. l), r) and t);

d) with a fine of 3,000 lei to 15,000 lei for the offenses set forth in art. 60 lit. j) and p);

Who can issue fines?

Article 62 – (1) The verification of the infractions provided for in article 60 and the application of the sanctions provided for in article 61 are carried out by non-commissioned officers and civil protection and fire officials with powers of orientation, control and verification, namely, those designated by the inspector general.

(2) The verification of the infractions provided for in article 60 and the application of the sanctions provided for in article 61 are carried out by:

a) labor inspectors, for the offenses set forth in article 60 letters a), q) and r);

b) control personnel within the Department of Emergency Situations, as well as non-commissioned officers and civil protection and fire officials, for the offenses set forth in art. 60 lit. b), c), d), e), f), g), h), i), j), k), l), m), n), o), s), ș) and t);

c) police officers and officers, non-commissioned officers and gendarmerie, local police, for the offenses set forth in art. 60 lit. d), e), g), h), i), j), k), l), m), n), o), r) and ș);

d) the personnel of the public health directorates, for the infractions foreseen in art. 60 lit. h) and i);

e) the personnel designated by the Ministry of Transport, Infrastructure and Communications, for the infractions foreseen in art. 60lit. P);

f) traffic police and officers, for the offenses set forth in art. 60 lit. p), in relation to road transport.

Deadline for payment of the fine.

Fines can be paid at half the amount applied (not half the minimum) within 15 days, according to the voted law:

(1) The offender can pay, within a maximum period of 15 days from the date of delivery or communication of the minutes, half the amount of the fine applied by the agent that determines the infractions provided by law.

(2) The amounts resulting from the fines applied for the infractions foreseen by this law will be entered in the total income to the state budget.
