Dozens of lawyers organized a protest on Monday at the Bucharest Palace of Justice against the sentence of their colleague Robert Roşu to five years in prison with execution in the “Ferma Băneasa” case.

“Prohibition to identify the lawyer with the client”, “# alăturideRobert”, “Alignment of criminal justice with the rule of law”, are the messages on the banners carried by the protesting lawyers on the steps of the Palace of Justice, reports Agerpres .

The lawyers’ gesture comes after the Romanian Lawyers Union (UNBR) harshly criticized the conviction of lawyer Robert Roşu and announced that it supported the protest, including by not participating in the court hearings of the Supreme Court panel that convicted to the lawyer.

Thus, in a press release issued on Friday, the UNBR considered that the “radical discrepancy” between the acquittal issued in the case of lawyer Robert Roşu by the Braşov Court of Appeal and the 5-year prison sentence applied by the Supreme Court “shows the weaknesses of the system, with consequences on the credibility of justice, both among lawyers and the general public.”

“From the case of the lawyer Robert – Mihăiţă Roşu, convicted in the case ‘Băneasa’, on December 17, 2020, UNBR returns to the discussion of the professional body, the authorities and the public the problems related to the prosecution and conviction of lawyers for the measures taken in representation and advice. client (…) Since one of the courts determined that all the acts of the lawyer fall within the normal practice of the legal profession (drafting of contracts, notifications, memoranda) and that no it is clear that he has committed any act of claim “In exchange for the promise to intervene with the competent officials to order the return of the merchandise claimed by one of the defendants whom he represents, it is unacceptable and incomprehensible how, in the same case, the decision The end is radically different. ”declares UNBR.

On the other hand, the president of the Supreme Court, Corina Cretu, transmitted this Saturday, in a press release, that the Superior Court of Cassation and Justice recognizes and supports the fundamental right to free expression of any person or organization, even as to express critical thanks. Regarding judicial decisions, however, “the public discourse on the public service of justice must, however, be characterized, beyond the emotional context, by rigor, balance and a minimum equidistance of all the people involved” .

Last Thursday, Robert Roşu, lawyer for Prince Paul of Romania, was definitively sentenced by the High Court of Cassation and Justice to five years in prison with execution in the case of the illegal restitution of the Royal Farm of Băneasa.

In the same case, Paul from Romania received 3 years and 4 months in prison, and businessman Remus Truică, 7 years, both sentences being with execution.

The allegations in the case concern crimes committed between 2006 and 2013 in various forms of participation, in order to obtain goods of special value, including the Snagov Forest and the Royal Băneasa Farm, claimed without right by Prince Paul.

According to DNA, Remus Truică, lawyer Robert Roşu and Israelis Tal Silberstein and Benyamin Steinmetz formed, since November 2006, a criminal group that aimed to obtain all the property illegally claimed by Prince Paul, offering money or goods to people inside authorities and institutions that own these properties.

Prince Paul promised Truica and his associates a significant share, between 50% and 80% of the value of the goods he claims in Romania, and then transferred the goods to them as they were obtained, through fictitious contracts of sale. with Reciplia SRL, represented by Remus Truică.

Prince Paul, Remus Truică and the other members of the group subsequently concealed the illicit nature of the agreement by concluding, on November 1, 2006, a contract for the transfer of assets in an administrative or judicial process for the restitution of assets. The contract was concluded between Prince Paul and SC Reciplia SRL, and was drafted by attorney Robert Roşu.

The damage in this case amounts to 145 million euros.
