The president of the Constitutional Court of Romania (CCR), Valer Dorneanu, declared this Thursday that the institution notified the European Commission, the Venice Commission, but also other international forums, after Prime Minister Ludovic Orban declared that CCR’s “political tricks” must be changed. “It is obvious that it is an attack on the rule of law” and “in no country in Europe is the prime minister allowed to use such language and such suburban attacks on the Constitutional Court,” said Dorneanu.

“I will talk to my colleagues, I have had discussions of this type before and I still have reservations about the opportunity to take a step forward. I think now that things have taken a scale that necessarily requires an intervention of this type in the Venice Commission, in the Council of Europe, in the Association of Constitutional Courts. (..) We intend to notify the Venice Commission and the Council of Europe and certainly the Association of Constitutional Courts of Europe, “said Dorneanu, according to News.ro .

When asked if he would address the European Commission about the attacks in the context of the Cooperation and Verification Mechanism (CVM), Dorneanu replied: “Of course the European Commission is one of the most important institutions, with the mechanism that I would refrain from developing many more thanks ”.

Dorneanu said Orban’s remarks represent unconstitutional pressure.

“Before or after a decision that we have to make, we endure media pressure of all kinds, starting with salaries, by those who listen to us … It is obvious that it is an evident, express and inappropriate pressure, lacking in principles and unconstitutional . There is no such pressure and such attacks from the Prime Minister in any state in Europe. Now, a politician, I can still accept that political opinion is free, but a prominent politician of the prime minister … “, added the president of the CCR.

He considers the prime minister’s statements to be an attack on the rule of law.

“It is obvious that it is an attack on the rule of law, because the institution of the CCR is a pillar of democracy, a pillar of the rule of law, a guarantor of the Constitution, of its supremacy and if one of the main actors Of the rule of law, such as the Prime Minister of the Government, attacks the other institutions that make up the constitutional set, obviously it is an attack on the credibility of that institution. If we were to declare that the decisions of the Government, before being appealed, are nonsense and that the Prime Minister or the Government do not know how, what would be chosen with the rule of law? What does the common citizen understand when the authorities must urge the common citizen to obey the law starting with the first state authorities? If they set a bad example, question the law themselves and urge citizens not to respect the decisions of the Constitutional Court, what kind of rule of law does this prime minister promote? Dorneanu also declared.
