Conditions for the survivor’s pension

Those who are less familiar with the latest conditions for the granting of the surviving pension should know that this type of pension is due to the children and the surviving spouse.

According to current regulations, children up to the age of 16 will receive an unconditional survivor’s pension.

What about those over 16?

“The surviving spouse is entitled to a survivor’s pension regardless of age, in the following situations:

The value of the survivor’s pension.

Thus, regarding the way in which the amount of the survivor’s pension is established, the calculations are made according to:

– old-age pension in payment or to which the deceased claimant was entitled

Total number of pension points

An important aspect of the survivor’s pension amount is also worth mentioning: it is calculated as a percentage of the total number of pension points earned by the deceased claimant based on the number of eligible descendants:

– 50%, if there is only one descendant;

– 75%, if there are two descendants;

– 100%, if there are three or more descendants.

In any of the cases related to pensions, the following formula works: the value of the pension of any person is calculated by multiplying the average annual score achieved by the insured person by the value of one pension point (not – established by law).

Average annual score

The average annual score obtained by dividing the total number of points resulting from the sum of the insured’s annual scores by the number of years corresponding to the total contribution period will be taken into account.

As the latest legislative updates indicate, we present the values ​​of the pension point:

– September 1, 2019 – 1265 lei

– on September 1, 2020 – 1,775 lei

– September 1, 2021 – 1,875 lei

Watch out! If the surviving spouse and the children of the deceased supporter are entitled to their own pension and furthermore meet the legal conditions for obtaining the surviving pension at the same time, they can choose to keep the most advantageous pension between the two.
