The medical certificate that AUR Senator Diana Șoșoacă used in the Senate not to wear a protective mask does not produce legal effects, and the Senate occupational medicine doctor is the only competent to say if the diagnosis is among those for whom masks protective, says the senator of the PNL Iulia Scântei, president of the Commission for the validation of mandates.

“This certificate does not produce legal effects. The occupational medicine doctor in the Senate is the only one competent to say if the diagnosis is among those for whom the use of a protective mask is not indicated. Until then, this certificate cannot be used to participate without a mask in the Senate. ” (…) There are many colleagues with chronic diseases and they feel threatened by the non-observance of the measure of wearing the mask, ”said Senator Iulia Scântei, on Monday night, on Digi 24.

She specified that, in the end, Șoșoacă used a transparent protective device in the Senate.

The attorney claimed that he has a certificate advising him not to wear a mask due to a medical condition. We remind you that he also wore a mask under his nose in consultations in Cotroceni Șoșoacă, when he invoked a medical certificate for the first time.

The validation commission sent two addresses: one to the Ministry of Health and the other to the DSP, in which it attaches the medical certificate that Diana Șoșoacă brought, warning her “not to wear a protective mask according to order MS / MAI 874/81/2002”.

The medical certificate is dated 09/18/2020 and was issued by the Dr. Bulbuc Aurora Diagnosis and Treatment Center (Șoseaua Stefan cel Mare Bucharest), primary care physician – general medicine, pediatrics.

Codes 453 and 515 appear on the medical certificate. According to the list of international classifications of diseases, these codes correspond to “Essential hypertension” and “Rhinitis, rhinopharyngitis and chronic pharyngitis”.

The Senate asks the Ministry of Health and the DSP to verify whether:

  • the diseases mentioned in the medical certificate are part of the category of diseases that affect the oxygenation capacity
  • the medical certificate was issued in compliance with the legal competence established by order MS / MAI 874/81/2002
  • the certificate holder is exempt from wearing a protective mask indoors
