The Craiova Court of Appeal decided to reduce the amount of non-pecuniary damage to be paid by the defendant Anghel Sandu to the civil party Matei Valeriu, from 40,000 to 10,000 euros.
It rejects, as unfounded, the appeals declared by the Prosecutor’s Office, the defendant Anghel Laurenţiu and the civil party Matei Valeriu. The appeal declared by the defendant Anghel Sandu admits. It annuls, in part, the sentence from the civil aspect. It reduces the amount of the moral compensation to which the defendant Anghel Sandu was obliged to the Matei Valeriu civil party, from 40,000 euros to 10,000 euros, an amount that will be paid in lei at the NBR exchange rate from the date of payment. The Olt Court decided on October 21, 2021 to sentence Bercea Mondialu to 13 years and 272 days in prison.
“He sentenced the accused Anghel Sandu, called Bercea Mondialu, to the main prison sentence of 6 (six) years in prison for the crime of attempted simple homicide (an act committed on January 22, 2009, to the detriment of the injured Matei Valeriu) (. ..) It confirms that the present act, committed on 01.22.2009, is concurrent with the facts for which the defendant Anghel Sandu was convicted by Criminal Judgment No. 209 / 04.04.2017 of the Court of Dolj, (…) with the facts (…) for which the defendant Anghel Sandu was convicted by Criminal Judgment No. 29 / 02.22.2012 of the Olt Tribunal, (…) and by Criminal Judgment No. 83 / 01.20.2015 of Argeş Court. (…) Finally, the defendant Anghel Sandu will execute: – the main sentence resulting from 13 years in prison and 272 days in prison, in prison (…), deducts the period executed as of 20.02.2011 to 05/16/2014, to 05/17/2014 to 08/03/2014 and from 08/04/2014 to 02/08/2019. In the same case, Sandu Anghel’s son, Laurenţiu Anghel, was also sentenced to prison with execution.
“(…) condemns the defendant Anghel Laurenţiu to the main penalty of 9 years and 6 months in prison, for the commission of the crime of attempted murder for the crime of particularly serious murder (the act committed on 01.22.2009, in detriment of the aggrieved Matei Valeriu and of the aggrieved party Văduva Gheorghe Adrian) (…) It considers that the present fact coincides with the facts for which the accused Anghel Laurenţiu was convicted of: – Criminal judgment No. county of Piteşti, (…) – Criminal judgment No. 268 / 26.03.2009 of the Court of Slatina (…) Finally, the defendant Anghel Laurenţiu will execute: – the most severe main sentence, 9 years and 6 months from prison, in detention regime, (…) deducts the period executed from 08.08.2011, to 02.01.2019 (…), annuls the conditional release of the accused Anghel Laurenţiu, ordered by Criminal Sentence No. 14 / 08.01.2019 of the District Court of Drobeta Tr. In this case, Sandu Anghel and her son, Laurenţiu, were sent to trial in 2018 by the prosecutors of the General Prosecutor’s Office, for attempting the crime of aggravated homicide. The incident took place on January 22, 2009, in Slatina, where the former deputy mayor of the municipality, Valeriu Matei, was beaten by Bercea with a knife, in the midst of a spontaneous conflict generated by misunderstandings about the land. In the same context, Valeriu Matei, as well as a man accompanying him, were run over by Laurenţiu Anghel with a car.
As a result of the altercation, both people suffered traumatic injuries that endangered their lives, one of them required 12 to 13 days of medical attention to heal, and the other 80 to 90 days.
Sandu Anghel was released from prison in February 2019, serving a sentence of 8 years and 9 months for stabbing his nephew, and Laurenţiu Anghel was arrested for complicity in a robbery.
Both were identified by the police officers of the Criminal Investigation Service – Investigation Department, in collaboration with the Drobeta Turnu-Severin Police.
