The decision can be appealed.
According to the ruling, Mirel Palada must pay Mihai Gotiu the amount of 5,000 euros in moral damages.
During the supervision period, Mirel Palada must comply with the following supervision measures:
a) Report to the Bucharest Probation Service, on the dates set by it;
b) Receive visits from the designated probation counselor with their supervision;
c) Announce, in advance, the change of address and any trip that exceeds 5 days, as well as the return;
d) Communicate the job change; e) communicate information and documents capable of allowing control of their means of subsistence.
The court drew Mirel Palada’s attention to the fact that if he violates the conditions of supervision, the postponement of the sentence can be revoked and the sociologist could execute the sentence in the penitentiary.
“Based on art. 83 para. (4) of the last sentence of the Penal Code, the defendant Palada Theodor Mirel draws attention to the provisions of art. 88 of the Penal Code in relation to the revocation of the postponement of the sentence and the execution of the prison sentence, in case of non-compliance, in bad faith, of the supervision measures or of the obligations imposed by the court or established by law, if the civil obligations established by the court are not fully fulfilled until the expiration of the supervision period, as well as if the accused commits another crime during the inspection period ”, is shown in the judgment of the Court of First Instance, according to the judicial portal.
