This law allows the employer to reduce the working hours of employees, by no more than 50% of the duration provided for in the individual employment contract, with the proper distribution of working hours and the corresponding reduction in salary.

During the state of emergency / alert / siege, as well as for a period of up to 3 months from the end of the last period in which the state of emergency / alert / siege was established, “employers have the possibility to reduce the time of work of the employees with a maximum of 50% of the daily, weekly or monthly duration, foreseen in the individual employment contract, with the information and consultation of the union, the workers’ representatives or the workers, as the case may be, prior to the communication of the worker’s decision ”.

„Reduction of working time under the conditions specified in par. (1) It will be established by decision of the employer, for a period of at least 5 business days per month, with the employer having the obligation to establish the work schedule for the entire month. The reduction of working time also applies in the case of shift work hours, as well as in the case of unequal working hours. The employer’s decision on the reduction of working time, working hours, how to distribute it by days and the related salary rights are communicated to the worker at least 5 days before the effective application of the measure ”, stipulates the law, informs Agerpres.

The normative act also establishes that, during the reduction of working time, the employees affected by the measure benefit from compensation of 75% of the difference between the gross monthly basic salary provided for in the individual employment contract and the monthly basic salary gross corresponding to hours actually worked. as a consequence of the reduction in working time, in addition to the salary rights due, calculated in the real time worked.

The government regulated the reduction of working time through GEO

In August, the Government regulated, through an emergency ordinance, the possibility of reducing working hours, granting subsidies for day laborers and seasonal workers, as well as promoting teleworking.

According to GEO 132/2020, in case of temporary reduction of the activity determined by the establishment of the state of emergency / alert / siege, according to the law, employers have the possibility to reduce the working time of employees by no more than 50 % of the duration provided for in the individual employment contract, with the information and consultation of the union, the workers’ representatives or the workers, as the case may be, prior to the communication of the worker’s decision.
