What is written in the PSD complaint to the CNA:

  • At the same time, through this live intervention Mr. Klaus Iohannis has made it difficult for the broadcasters, as a seemingly informative program about the president’s work suddenly became an electoral program, which prevented from fulfilling its obligations through documents submitted to the NAC on how the campaign reflects on the calendar. choice.
  • Klaus Iohannis’ speech is clearly electoral propaganda material, considering that, within the meaning of Law 334/2006 on financing the activity of political parties and electoral campaigns, the propaganda material is defined by art. 36, para. (7) as follows:
  • However, note that the president’s speech cumulatively meets all these conditions listed above, respectively, it refers directly to both the National Liberal Party (in a positive sense) and the PSD in a negative sense, it is used in full election campaign, It has a declared electoral objective (to win the parliamentary elections for the National Liberal Party) and clearly exceeds the objective of informing the public.
  • Through the live intervention of President Klaus Iohannis, he obtained, in fact, illegally, for the National Liberal Party, additional airtime for electoral broadcasts, in violation of art. 8 paragraph 3 of Decision NAC no. 603 of October 21, 2020.
  • By broadcasting President Klaus Iohannis’ speech campaigning for the National Liberal Party, the party illegally gained additional time to broadcast election propaganda materials, circumventing mandatory rules to establish specific assigned segments.
  • President Klaus Iohannis’ speech endangered the constitutional order, thus violating art. 8 paragraph 2 letter a) of NAC Decision no. 603/2020.
  • Contrary to both the demands of a democratic society and his constitutional prerogatives, Mr. President campaigns against the National Liberal Party and denigrates another electoral competitor, in this case the PSD, directly conveying the message that the PSD should no longer participate more in political life and must disappear.
  • Through the president’s speech, evidently biased and false messages against the PSD were disseminated in the public space, which flagrantly violate both the constitutional order and the audiovisual legislation, as we have previously shown.
  • The holding of free and fair elections can only take place in the context of respect for democratic values ​​as a whole, which include the non-participation of the president in the electoral campaign and the prohibition of defamatory messages to competitors.
