The Ministry of Culture announced this Wednesday, through a press release, that it will form a working group to modify and complement Law 8/1996 on copyright and related rights, following the notifications received from cultural operators and visual artists regarding the methodology of taxation of publicly exhibited works, proposed by the collective management entity VISARTA. The law targets hundreds of thousands of employees, and the question that remains after this news is how much we will pay for the implementation of the new law.
According to the cited source, the current legal framework limits the possibilities that both the Ministry of Culture and the Romanian Copyright Office (ORDA) have for the development of the methodology of collective management bodies in the areas of activity regulated by the Law 8/1996.
“In the spirit of transparency that we have promoted since I took office, next week I will announce the composition of the working group to modify and complement Law 8/1996. It will be a teamwork with specialists from all cultural sectors to arrive at the best, sustainable solutions, so that the rights of all artists are defended without leaving room for interpretations or loopholes for abuse. We cannot accept monopolistic actions that harm artists, ”said Culture Minister Bogdan Gheorghiu.
The Ministry of Culture stated that it has no responsibilities regarding the decision to establish the negotiating committee and the methodology of the management bodies and affirms that the improvement of the copyright and related rights management system and the prevention of abuses can be it is only achieved by modifying Law 8/1996.
„ORDA, according to Art. 163 of Law 8/1996, has the obligation that, within 15 days of receipt of the request, to initiate negotiation procedures by the collective management bodies, users or user associations. provided for in art. 163, para. (3) on. b) and c), prepare the order of constitution of the negotiating commission; ORDA is not a party to the negotiations and cannot intervene in the negotiation between the collective management bodies and the users, ”the ministry explained.
