“Between 2008 and 2015, the defendants of Societatea Companiilor Hoteliere Grand SRL, Gregor Aufhauser – as chairman of the board and Kathrin Brettschneider – as a member of the board of directors and chief financial officer recorded in accounting documents and annual financial statements, repeatedly, an unrealistic operation, namely that the loan agreement, called “ repayable contribution agreement ”, concluded on January 18, 1995 with ILBAU GmbH Vienna, for the amount of 17,792,665 euros, illegally recording it in the account 1624 – External bank loans guaranteed by the state, although, according to the Accounting Regulations approved by order of the minister, it should have been registered in account 1661 – Debts with affiliated entities, “said the prosecutors.
According to the researchers, taking advantage of this “unreal” operation, they were recorded in the accounting and deducted, when calculating the tax profit, interest expenses in the amount of 30,422,698.78 lei and losses due to exchange differences in the amount of 21,825,116.59 lei, which caused a decrease in tax profit with a total amount of 30,228,134 lei and income tax owed to the state budget with a total amount of 4,836,501 lei.
The Prosecutor’s Office announced that the damage caused to the state budget, in the amount of 4,836,501 lei, was fully recovered during the criminal investigation.
