The PSD MEP, Carmen Avram, explained, exclusively for DC NEWS, what are the main problems of the provisional agreement at the European Parliament level, which conditions the granting of European funds to respect the rule of law.
The S&D MEP stressed that not all European states supported this agreement. For example, Poland and Hungary are totally against this conditionality, and the Nordic states and Austria have considered that it is very little and that, if European funds are granted according to their needs, regardless of the internal legal situation, there is the risk that the money to reach the oligarchs, not the needy. “The Prime Minister of Hungary, Viktor Orban, the Prime Minister of the Czech Republic, and the Poles, accused of violating the rule of law through various measures taken, were attacked here,” said Carmen Avram.
“Cruel negotiations have been carried out, but an agreement has been reached. This means that if an EU state does not respect the rule of law, it will not receive the money. We are talking here about the rescue fund after the pandemic, which 750 billion euros“Carmen Avram told DC NEWS.
Three main problems
The problems of those who oppose, but also of those who are trying to find out how it is possible to impose such a measure are the following:
1. This question should or should not exist in the European Treaties. Make the granting of European money subject to anything. Therefore, the treaties should have been changed, because nowhere is it stipulated that European money cannot be given to a state that contributes to the European budget every year. Romania, for example, will send 20,000 million euros over the next 7 years. The question is how is a country denied European funding, given that it contributes to the EU budget?
2. The second problem is that it is not known who evaluates this. It is possible for a state to complain to the European Council that another state does not respect the rule of law. The Council will also meet and determine if the complaint is real or based on incorrect data. The problem is that it is not clear who is evaluating whether that state violates the rule of law. You can’t really assess a state, as long as there are more than 20 different legal systems in 27 member states. So Poland has a system of laws and enforces them ad-literam. If it appears to Austria, Germany or the Netherlands that Poland is violating the rule of law, it would mean that it should be based on the Polish legal system, not another country. The problem is who evaluates and based on what!
3. Possibilities such as using this conditionality to wage an internal political struggle and overthrow a government have not been considered. There are many people in Brussels, perhaps all of them, who play to get revenge on the leader of their country, who is from a rival party. I also noticed it in the vote for the Common Agricultural Policy. There were people who voted against it to hurt the leader at home. There are many examples that can be given. The Bulgarian socialists voted against harming the liberal prime minister. So are the Hungarian socialists, “added the MEP.
The weapon to be used against Romania
“No one knows if there is someone who looks closely at possible accusations against a state, and if someone is objective enough to decide whether the accused state is really guilty. In Romania, I think this weapon will be used. Usually by whoever has used it before. We in the EP could have said a lot against the government this year. But I never did. No Romanian Socialist MEP complained in Brussels about the statements made in Bucharest, which obviously violated the Constitution and, furthermore, the rule of law. I don’t think the PSD is ever going to use this weapon against the liberals, because the situation is clear to the PSD. I give to the liberals, I give to my country! It is not remembered who was in power when for three years there was talk about how corrupt Romania is. This weapon will be used if someone who has not used it in the past is in power.
So I think the decision is lax. Measures must be taken to ensure that this conditionality is not abused and that these complaints are carefully analyzed, ”concluded Carmen Avram.
