On the other hand, the judges invalidated the mandates of ten general councilors, among whom was Dumitru Dragomir.

“It invalidates the mandates of the following local councilors declared elected to the General Council of Bucharest: 1. Firea Gabriela; 2. Roman PetreM 3. Dinu Corneliu-Constantin; 4. With the exception of Dumitru Dragomir, the others resigned from the positions obtained at CGMB.

The court’s decision is communicated to the prefect, the general secretary of the Bucharest municipality and the declared elected local councilors whose terms have been invalidated.

The decision is not final and can be appealed within 3 days after communication.

On October 8, Dumitru Dragomir, elected from the PSD lists, declares that he will not resign as general counsel.

“I will be general counsel. I took a minute, filled out everything I needed, made the meeting. (…) I am not giving up. I am an elected body, the people elected me,” Dumitru Dragomir said at the time.

Subsequently, the president of the PSD, Marcel Ciolacu, declared that the presence of Dumitru Dragomir in the General Council is “untimely”, and his situation will be analyzed by the organization of the Sector 3 party.

“I had a separate discussion with the president of the Sector 3 organization, because I took note of the public statements of Mr. Mitica Dragomir. I asked the Sector 3 organization to urgently analyze the situation, so that until validation they have a decision of the organization whether or not Mr. Mitica Dragomir is validated as general councilor of the Capital, I have expressed my point of view towards my colleagues, which is normal, now it follows the decision of my colleagues from Sector 3. I would not want to enter in details, not even with Mr. Dragomir, not even with the present. I consider the presence of Mr. Mitica Dragomir on the list of general councilors inappropriate, “Ciolacu affirmed on October 9.

The validation of the general councilors was delayed, due to ambiguities about the competent court to decide in this case.

In fact, the elected mayor of the capital, Nicusor Dan, said last week that the inauguration will be delayed between 7 and 10 days, because, according to the Administrative Code, the mayor must take office with the General Council, but not It was like this. still validated by the court.

“Unfortunately, the taking of my mandate will be delayed for 7 to 10 days, which is not good from the perspective of the medical crisis we are in. Here is the explanation: The administrative code says that the mayor takes office ( takes an oath) with the General Council Both the mayor and the council must be previously validated by the court.

The administrative code has a slightly confusing wording about the competent court in Bucharest: the mayor and the Council are validated by the court in whose zone the electoral district in which the elections were held is located. The Bucharest Court validated my mandate a few days ago and recognized that since no district court covers the Bucharest constituency, the Bucharest Court has jurisdiction. However, today, through another panel, the Bucharest Court sent the file for the validation of the general counsel to the District Court 1. After the motivation (in 1-2 days), the file will reach the District Court 1 The Court will probably send it to Court. There will be a conflict of jurisdiction and the case will go to the Court of Appeal, which will refer it to the Court. After that, we will wait two more days for a possible call, ”explains Nicusor Dan on October 14.
