Eibar captain Sergi Enrich and two other former teammates, Antonio Luna and Eddy Silvestre, risk two years in prison.

The footballers Sergi Enrich (one of the Eibar captains in La Liga) and Antonio Luna (former Eibar, currently in Girona) admitted this Wednesday that they recorded a woman and then released a video without her consent that later went viral.

The two La Liga players admitted their guilt and publicly apologized to the woman in question, while ensuring that the video in question only reached Eddy Silvestre, the Albacete footballer, a close friend of the two. “I want to apologize. These are harsh images and I am very sorry for what I did. I couldn’t even see the videos.” said Sergi Enrich, current captain of Eibar. “Sending the video to Eddy (not Silvestre) was a big mistake, but I can assure you that only the images reached him. I asked him to delete them the next day.” he also told authorities.

Regarding the consent to the recording of the video, he acknowledged that the woman stated that “You do not want to register”. He also said that “She asked us to remove them and at that point we did”. In turn, the other soccer player involved in the case, Antonio Luna, also admitted the facts and stated that during the act he took Sergi Enrich’s cell phone and registered the deed, without the plaintiff’s consent.

What are the three footballers risking? The Spanish press gives ample space to the case

However, the video went viral in 2016, but Eddy Silvestre, who played four months at Eibar and now plays for Albacete, confesses that he does not feel responsible for its dissemination in the online environment, writes El Diario Vasco.

The footballer explained that he does not remember if the images were sent to the group of footballers by WhatsApp. “I deleted the images as soon as I saw them. I can say that I understand the victim, but I have absolutely nothing to do with her.” Silvestre explained, quoted by the newspaper MARCA.

The Gipuzkoa Prosecutor’s Office announced that Enrich and Luna are accused of a crime against privacy contemplated in article 197 of the Penal Code, for allegedly recording the images without the consent of a third person, and then spreading them to other people.

The prosecution’s request is that the two footballers be punished with five years in prison, but Sergi Enrich and Antonio Luna could escape with only two years. For his part, Eddy Silvestre is accused of spreading the images, knowing that they were taken without the consent of the woman involved. He risks between one and three years, but in his case, Diario Vasco writes, the aggravating factor is applied, so his sentence can reach two or three years. The prosecutor requests the maximum amount for the three players.

Eddy Silvestre Pascual Israfilov is 28 years old and plays as a midfielder in Albacete. Born in Roquetas de Mar, but due to his origins (his mother is Azerbaijani), Eddy has played for the Azerbaijani national team since 2015.

The toughest name on the list of prosecutors, Sergi Enrich, is 30 years old and the captain of the first league team, Eibar. The Ciutadella-born footballer has 160 games and 31 goals for the Basque national team and has also played in Mallorca, Recreativo, Alcorcón or Numancia in his career.

Defender Antonio Luna is 29 years old and played two seasons for Eibar. Born in Son Servera, Antonio Manuel Luna Rodríguez is a well-known footballer in Spain. He also played in Seville, Almería, Mallorca, Aston Villa, Verona, Spezia, Levante or Rayo Vallecano. He is currently a player for the second league team, Girona.
