On Friday, October 2, a legislative proposal to fix the date of the parliamentary elections was registered in the Senate. The proposed date is March 14, 2021. The initiator is Independent MP Adrian Dohotaru, a former USR member.

The judges of the Constitutional Court rejected, this Tuesday, the referral of President Klaus Iohannis and decided that the law that establishes that Parliament establishes the date of parliamentary elections is constitutional. Călin Popescu Tăriceanu, the ALDE leader, has already publicly demanded the postponement of the parliamentary elections until March 2021. The Orban government had set the date for the parliamentary elections for December 6, but the current epidemiological context could prevent the timely elections.

LAW on the setting of the date of the elections for the Senate and the Chamber of Deputies, once the mandate of the Parliament elected in 2016 has ended, as well as the measures for their proper organization

Romanian Parliament adopts this law

Art. one. The date of the elections for the Senate and the Chamber of Deputies, organized as a result of the termination of the mandate of the elected Parliament in 2016, is set for Sunday, March 14, 2021.

Art. two. – The electoral period of the elections provided for in art. 1 starts on January 13, 2021.

Art. 3. – Within a maximum period of 3 days from the date provided for in art. 2, by decision of the Government, the calendar of actions within the electoral period of the elections to the Senate and Chamber of Deputies provided for in art. one.

Art. Four. – (1) They are and remain valid for elections organized on the date provided in art. 1, the following electoral acts and operations drawn up and executed for the elections to the Senate and the Chamber of Deputies scheduled for December 6, 2020:

a) The lists of supporters of political parties, citizen organizations belonging to national minorities, political alliances, electoral alliances and independent candidates, which may be submitted, in accordance with the law, to the Central Electoral Office and the electoral offices of the constituency until the date established by art. . 3;

b) Applications for registration as a voter by correspondence and as a voter from abroad, formulated in accordance with art. 4 par. (4) of Law no. 288/2015 on voting by mail, as well as the modification and complementation of Law no. 208/2015 on the election of the Senate and the Chamber of Deputies, as well as for the organization and operation of the Permanent Electoral Authority, with subsequent modifications and terminations, and art. 42 par. (2) of Law no. 208/2015 on the election of the Senate and the Chamber of Deputies, as well as for the organization and operation of the Permanent Electoral Authority, with subsequent modifications and terminations;

c) The lists of supporters that are submitted to the Central Electoral Office and the electoral offices of the constituencies, which may be updated and / or modified, until the date established according to art. 3;

d) the establishment and completion of the Central Electoral Office and constituency electoral offices;

e) The decisions of the Central Electoral Office and the electoral district offices through which lists of supporters, candidates and electoral alliances were registered.

(2) The period of registration as a voter by correspondence and as a voter from abroad for the elections organized on the date provided in art. 1 begins on the date of entry into force of this law and ends on the expiration date of the terms provided in art. 4 par. (4) of Law no. 288/2015, with subsequent modifications and completions, and art. 42 par. (2) of Law no. 208/2015, with subsequent modifications and completions.

(3) As of the effective date of this law, the activity of the Central Electoral Office and the constituency electoral offices constituted for the Senate and Chamber of Deputies elections on December 6, 2020 will be suspended to date. provided for in art. two.

(4) During the suspension of the activity of the Central Electoral Office and the electoral district offices, all the acts and documents received, prepared and maintained by them will be kept by the Permanent Electoral Authority.

(5) Delivery of the upon receipt of the acts and documents provided for in para. (4) will be based on minutes.

Art. 5. – The assets acquired for the elections to the Senate and the Chamber of Deputies that were scheduled for December 6, 2020 until the date of entry into force of this law will be duly stored and conserved by the public authorities that acquired them, in order to to use them for the elections organized on the date specified in art. one.

Art. 6. – The amounts assigned according to art. 1 par. (1) of Government Decision no. 755/2020 on the establishment of the necessary expenses for the preparation, organization and conduct of the elections for the Senate and the Chamber of Deputies in 2020, the Ministry of the Interior, the Permanent Electoral Authority, the Ministry of Foreign Affairs, the National Agency of Integrity, the National Council for the study of the Security Archives, the Special Telecommunications Service, as well as the General Secretariat of Government, for the National Institute of Statistics and that they are uncompromised and / or unused to date Once this law enters into force, it will be returned to replenish the Budgetary Reserve Fund. , within the 30 days following the date of entry into force of the law.

Art. 7. – On the date of entry into force of this law, the following will be repealed:

a) Government Decision no. 744/2020 on the establishment of the date of the elections for the Senate and the Chamber of Deputies from 2020, published in the Official Gazette of Romania, Part I, no. 816 of September 4, 2020.

b) Government Decision no. 745/2020 for the approval of the calendar of actions within the electoral period of the elections for the Senate and the Chamber of Deputies from 2020 published in the Official Gazette of Romania, Part I, no. 817 of September 4, 2020.

This law was adopted by the Romanian Parliament, in accordance with the provisions of art. 75 and art. 76 par. (1) of the Romanian Constitution, republished.
