After four years of investigation and trials, the Târgu Mureş District Court sentenced the 25-year-old man to five years and four months in prison for continued fraud. The young man from Târgu Mureş was only 20 years old when he managed to enter the graces of the rich old woman, presenting himself as an orphan and homeless child. In reality, the individual was a pimp who facilitated the prostitution of minors. In 2017, he was sentenced with suspension for pimping, without the old woman, who thought she was a poor orphan, knowing about his criminal situation.

The woman owned two buildings in Târgu Mureş, which had several apartments rented to different people. During April 2015, she rented the 20-year-old, with whom she became very close in time, in a context in which she had no children or relatives in Târgu Mureş.

He signed to the limit, without knowing what he signed

After a few months, managing to gain the trust of the owner, he offered to help her obtain European funds for the renovation of the two buildings, informing her that she had to sign a special power of attorney before a public notary, by which she was empowered. to carry out any transaction related to the respective properties, granting full rights.

Thus, the young man convinced the owner to go to a notary in Târgu Mureş, where a power of attorney was signed empowering the so-called “orphan” to carry out property management operations, but also to represent her before full powers, for the purposes to sell the properties indicated above, at the price and conditions that he himself will establish. To be credible, the scammer had several people call the old woman and falsely tell her that the case to obtain European funds had been pre-approved. And to support the project, the octogenarian also had to contribute a certain amount.

In front of the court, the old woman stated that she did not want to sell those flats, but only wanted to conclude some mortgage contracts to obtain European funds. The old woman claimed that the notarial deeds were not read to her before signing them. The woman had blind trust in the scammer who took her money out of her accounts as soon as he sold the apartments. In fact, shortly after running out of the seven apartments, she claimed that “the rich made the orphan do those things.”

Diagnosed with dementia, the old woman was easily influenced

During the trial, a forensic psychiatric examination was carried out, after which it was established that the 84-year-old woman suffers from incipient senile dementia and severe visual disturbances, being classified as severely disabled.

The medical-legal conclusions highlighted that “regarding the mental capacity of the injured person to assess the socio-legal consequences of the provisions concluded in the 2015-2016 period, it was diminished, the injured being easily suggestible and influential in the context of pathology deteriorating. severe psychiatric vision loss; Regarding visual acuity, it was estimated that in the period 2015-2016 the injured person could not take note of written information, in the context of the marked decrease in vision ”.

The scammer had a flattering attitude towards the landlord.

During the trial, several witnesses were heard, including real estate agents that the scammer found through small advertisements in the newspapers.

One of the witnesses reported that the man wanted to get money very quickly, that he was “deceiving people”, respectively, he offered them offers to his detriment and asked him to perform in front of the old woman. Another witness said that the 20-year-old presented the octogenarian as a wealthy person, whom he had to use, implying that he was trying to “leave her without real estate.” The witness told the judges that she noticed that the defendant “had a flattering attitude towards the injured person in the sense that he called her, visited her, even slept with her, treated her, but nevertheless, the defendant did these things alone to take advantage of the injured ”.

During the investigation, the prosecutors instituted seizures in the seven apartments sold, but the court ordered that the seizures be lifted, noting that the goods are not in the name of the defendant, but of owners who bought them in good faith, so that Extended confiscation provisions apply.
