On Thursday, DNA military prosecutors ordered the criminal investigation against the head of the Romanian Gendarmerie, Bogdan Enescu, accused of illegally collecting money for hundreds of overtime.
Bogdan Enescu and two subordinates, including Cătălin Şindile, who coordinated operations at the diaspora rally, were heard Thursday by DNA prosecutors.
All three are being prosecuted for allegedly working illegal overtime during the state of emergency. According to some sources, the head of the Gendarmerie allegedly received an additional 40,000 lei and the other two colleagues in the criminal case 20,000 lei each.
Colonel Bogdan enescu, the head of the Romanian Gendarmerie, explained to DNA how it would have been approved for an additional 900 hours of work. Before speaking to prosecutors, the head of the gendarmerie said he was innocent and did not need a lawyer to defend him.

A former head of the gendarmerie, Colonel Cătălin Şindile, was also accused of receiving money in exchange for overtime, without rights. Cătălin Şindile is the one who led the institution on August 10, 2018, at the diaspora rally and coordinated the events since then.

Colonel Cătălin Şindile is a suspect, as is another colleague, General Constantin Florea, who was also the director of the institution. The accusations made by the prosecutors are of usurpation of the function and obtaining undue benefits.
The DNA file was opened after a notification made by the control body of the Interior Minister. MIA representatives searched the gendarmerie in July and found irregularities in the way overtime is allocated. Only in the case of the three gendarmes with high positions, the damage reaches 80 thousand lei, say sources of the investigation ”.
Prosecutors indicate in the ordinances that the three would have collected, during 2020, monetary rights for a total amount of 79,852 lei that represent overtime, without any legal justification based on any provision of the hierarchical superior and without any basis that justifies the operative or unforeseen nature of the activities carried out.

-► SINDILE IONUȚ-CĂTĂLIN, reserve colonel, at the time of the events authorized the inspector general of the General Inspection of the Romanian Gendarmerie, former commander of the School of Enforcement for Officers of the Romanian Gendarmerie “Mihai Viteazul”, for committing the crime of usurpation of public office obtained for him or for another an undue benefit, on a continuous basis (7 material documents).
The orders of the prosecutors establish that there is data and evidence in the case that indicates the following fact:
The three suspects allegedly received, during 2020, monetary rights for a total amount of 79,852 lei that represent overtime, without any legal justification based on any disposition of the hierarchical superior and without any reason that justifies the operational or unforeseen nature of the activities carried out. .
As an authorized inspector general of the General Inspectorate of the Romanian Gendarmerie, the suspect Enescu Bogdan would have approved, between May and June 2020, the payroll and the monthly centralizers of the additional hours worked and would have collected monetary rights in the amount of 36,068 lei, representative of overtime, corresponding to the period January – April 2020, without complying with the legal provisions, respectively without the overtime having been ordered by the hierarchical superior and without the operative or unforeseen nature of the activities being produced from the documents drawn up. Specifically, the suspect allegedly collected money for overtime in violation of art. 21 par. (1) and (4) of Framework Law no. 153/2017 and art. 35 par. (3) and (6) of OuG no. 114/2018.
In turn, between August and October 2019, as authorized inspector general of the General Inspectorate of the Romanian Gendarmerie, the suspect Florea Constantin would have worked overtime without complying with the same legal provisions, would have subsequently requested the General Inspection of the Romanian Gendarmerie to grant him the corresponding salary increase, and based on the approval of the documents by the suspect Enescu Bogdan, (although the latter, at the time of overtime, was the chief inspector of the Ilfov County Gendarme Inspectorate, who is directly subordinate to the applicant), would have collected, in May 2020, monetary rights amounting to 15,619 lei.
Also, between September 2018 and March 2019, as authorized inspector general of the General Inspectorate of the Romanian Gendarmerie, the suspect Sindile Ionuț-Cătălin allegedly worked overtime without complying with the legal provisions, subsequently, in June 2020, he requested to the General Inspection of the Romanian Gendarmerie, granting the corresponding salary increase, and based on the approval of the documents by the suspect Enescu Bogdan, (although the latter, at the time of overtime, served as chief inspector of the Ilfov County Gendarmerie Inspectorate, being directly subordinate to the plaintiff), would have collected, in July 2020, monetary rights in the amount of 28,165 lei.
The suspects were informed of the procedural quality and of the charges, in accordance with the provisions of art. 307 Code of Criminal Procedure.
